| 520 | |e استهدف البحث الحالي تقديم دراسة مقارنة عن الجريمة المنظمة وجريمة الإرهاب. حيث تناول المقصود بالجريمة المنظمة ومعرفة الخصائص التي تميزها عن غيرها من الظواهر الإجرامية، وتعريف الجريمة الإرهابية وكذلك تحديد خصائصها، بالإضافة إلى تحديد أوجه الشبه وأوجه الاختلاف وذلك لرسم الحدود الفاصلة لكل جريمة منهما. كما أوضح بعض المطالب التي تتعلق بالجريمة المنظمة والخصائص التي تميزها عن غيرها من الظواهر الإجرامية كالجريمة المنظمة وتعريفها وتناولها من منظور فقهي. وتعريف الجريمة المنظمة في التشريعات العربية والغربية والمقصود بالجريمة المنظمة لدي المنظمات الدولية. وجاءت النتائج مؤكدة على أن الفارق الأساسي بين الإرهاب والجريمة المنظمة يكمن في الأهداف والبواعث. فهدف الجماعات الإرهابية هو القيام بتغييرات سياسية أو اجتماعية من خلال القضاء أو تعديل النظام القائم في حين ان الهدف من الجريمة المنظمة هو تحقيق الكسب المادي والربح السريع ولايتأتي لها ذلك إلا من خلال الخروج على شرعية الدولة وعن الشرعية بصفة عامة. كما ان اعتداءات 11 سبتمبر جسدت الشراكة بين الإرهاب والإجرام المنظم. فضلا عن اعتبار البعض ان فكرة الإرهاب صورة من صور الجريمة المنظمة نظرا للتشابه الكبير بينهما إلا ان ذلك لا يعني الخلط بين الجريمة المنظمة والجماعات الإرهابية. بالاضافة إلى أنه لابد من التمييز بين جريمة الإرهاب والجريمة المنظمة حيث بدأت الجماعات الإرهابية في العمل مع الجماعات الإجرامية خاصة مع تجمعات المخدرات وتجار السلاح والهجرة غير الشرعية وهذا بشكل مؤثر أعربت عنه الأمم المتحدة في العديد من المناسبات.\nكُتب هذا المستخلص من قِبل دار المنظومة 2018 |f The current research aimed to provide a comparative study about organized crime and the crime of terrorism. It dealt with the meaning of organized crime and the characteristics that distinguish it from other criminal phenomena. The research also tackled the definition of the crime of terrorism as well as its characteristics, in addition to identifying its similarities and differences in order to define each crime. In addition, the research clarified some of the demands relating to organized crime and the characteristics that distinguish it from other criminal phenomena such as organized crime and its definition. The research addressed the organized crime from a jurisprudential perspective. Moreover, the research turned to the definition of organized crime in the Arab and Western legislation and the meaning of organized crime according to international organizations. The results emphasized that the main difference between terrorism and organized crime lies in the goals and motives. The goal of terrorist groups is to make political or social changes through the abolishing or modifying the existing regime. Meanwhile, the goal of organized crime is to achieve material gain and quick profit. This can be only achieved through the sedition of the legitimacy of the state and the legitimacy in general. The September 11 attacks embodied the partnership between terrorism and organized crime. In addition, some people consider the idea of terrorism as a form of the organized crime because of the similarity between them, but that does not mean the confusion between organized crime and terrorist groups. Furthermore, there is a need to distinguish between the crime of terrorism and the organized crime. The terrorist groups have begun to work with criminal groups, especially with drug groups, arms dealers and illegal immigrants, and this has been dramatically expressed on many occasions by the United Nations.\nThis abstract translated by Dar AlMandumah Inc. 2018 | ||
