المستخلص:Limitation of liability for maritime claims is an important system for the shipping industry. The original rationale for such a system is to encourage the shipping enterprise. Operating a ship is a risky business. A shipowner is not only exposed to the perils of the sea, but also vulnerable to the negligence of the master and crew members wider the doctrine of respondeat superior, which holds the shipowner vicariously liable for the negligence of his employees. Maritime damage may give rise to liability of immense proportions, many limes the value of the ship and its cargo. Third party liability alone in such a casualty may lead to extremely large claims. By setting up certain limits, the system alleviates the shipowner's burden of liability, which provides an important incentive for people to stay in the shipping industry. \ Recause of the advantages which the limitation regime brought about to shipowners, maritime nations arowd the world felt compelled to adopt it in order to place their own merchant marines on an equal footing with their foreign counterparts. \ This article attempts to explore various Issues within the limitation system itself in the context of 1976 Convention and Kuwait Maritime Iaw.
