| المستخلص: | بالرغم من إغفال العديد من التشريعات لتعريف خطأ الفريق الطبي، إلا أن الفقه القانوني بذل قصارى جهده لوضع التعريف للمصطلح المذكور، ثم تبعه في ذلك أحكام المحاكم بما نتج عنه من عدم اختلاف لخطأ الطبيب عما إذا كان يعمل هذا الأخير منفرداً أو يعمل داخل نطاق الفريق. \ ويُعرف الخطأ في نطاق الفريق الطبي بأنه: "كل مخالفة أو خروج من الطبيب داخل الفريق الطبي في سلوكه على القواعد والأصول الطبية التي قضى بها العلم أو المتعارف عليها نظرياً وعملياً وقت تنفيذه للعمل الطبي وما ينشأ عن ذلك من إخلال بواجبات الحيطة والحذر بما ينجم عنه إلحاق الضرر بالمريض". \ ويتنازع معيار خطأ الفريق الطبي اتجاهان: يرى الأول عدم مسئولية الطبيب داخل الفريق الطبي لعدم القدرة على التحديد الحقيقي للمخطئ داخل هذا الفريق، أما الاتجاه الثاني فيؤكد على مسئولية الطبيب وذلك استناداً لنص المادتين 1382 و1383 من المجموعة المدنية الفرنسية، واللاتي تجعلان كل شخص مسئولاً عن تعريض الغير للضرر الذي يترتب على أي خطأ أو إهمال منه ما يفيد استثناء الأطباء وغيرهم من الأحكام الواردة في تلك النصوص. \ ويتنازع فكرة خطأ الفريق الطبي من حيث القبول أو الرفض رأيان: أحدهما مُؤيد للفكرة، والآخر معارض لها. ولقد تطور القضاء في تحديد مسئولية كل من الجراح وطبيب التخدير وفق المراحل الآتية: \ المرحلة الأولى: مسئولية الجراح العقدية عن خطأ طبيب التخدير. \ المرحلة الثانية: استقلال كل من الجراح وطبيب التخدير بخطئه عن الآخر. \ المرحلة الثالثة: مسئولية الفريق الطبي. \ المرحلة الرابعة: استقلال كل من الجراح وطبيب التخدير بمسئوليته مع تقدير وجود التزام متبادل بينهما بالمشورة. Despite the overlooking of much legislation to define the medical team error, the jurisprudence exerted much effort to define it, and was followed by the court judgments in which there is no difference in the medical error whether the doctor works individually or in a team. \ The error in the medical team is defined as «any violation of the doctor behavior on the medical rules which is acknowledged theoretically and practically by the science during executing the medical act. Or any defaults in the duties of precautions what causes damage to the patient. \ The standard of the medical team error is disputed in two trends: \ The first one is clearing the doctor from any responsibility while working in a team because it is not easy to determine who caused the damage, the second one confirms the doctor responsibility based on the text of the articles 1382 and 1383 from the French civilian group which make every person responsible for any negligence which lead to any errors what excepts doctors or others from the provisions contained in those texts. \ The idea of the medical team error between acceptance and rejection is disputed in two opinions: one supports the idea and the other opposes it. \ The judicial authority has developed in determining the responsibility of both the surgeon and the anesthesiologist according to the following stages: \ The first stage is the contractual responsibility of the surgeon about any errors made by the anesthesiologist. \ The second stage is that every one of the surgeon and anesthesiologist is responsible for his error. \ The third stage is the responsibility of the medical team. \ The fourth stage is that every one of the surgeon and anesthesiologist is responsible for his error while estimating the mutual commitment of the advice. \ |
