| المستخلص: | Civil system has known companies since ancient times, Roman law for instance included a kind of definition or a concept of a company and the statement of its elements, and as a result of the development of trade and its expansion , the need for legislation which regulates the companies seemed necessary. \ All of this led to the emergence of individual companies, especially solidarity company , and perhaps the industrial revolution and the evolution of the movement of commerce and industry, which was imposed by the need for huge capital, led to the emergence of corporate funds, which has achieved prosperous, broad spread ,and become as one of the types of companies that have effective impact in the national economy and public savings ,all of this have led the legislator to intervene and impose restrictions on the establishment and management of such companies to protect savers And national trade. \ |
