| المستخلص: | The positive law is an image for the form and the level of the state's culture and its civilization. Accordingly, the law in this case, interprets the social instructions and philosophical and human views of the so¬ciety. It contains the moral and economic aspirations, which are sought by the socie-ty. Moreover, the values of certain legal system is estimated in accordance with its concrete advantages and disadvantages, particularly, its efficiency. \ This study will consider the constitution of the fifth French Republic which was es¬tablished by General de Gaulle. This study also will examine the constitutional princi¬ples, which have been accommodated within the permanent Syrian Constitution of 1973 as a result of the revolutionary movement of President Hafaz Al-Asad. \ |
