| المستخلص: | معنى قاعدة (لا مشاحة في الاصطلاح): أن الخلاف إذا كان واقعاً في الأمور الاصطلاحية فإنه لا ينبني عليه حكم، ولا اعتبار به. \ وإنما يظهر إعمال هذه القاعدة فيما لو حصل الاتفاق على المعنى واختلفوا في التسمية أو في اللفظ، فلابد إذن من تقدير تتمة لهذه القاعدة، وهي: (بعد الاتفاق على المعنى). \ ثم إن هذه القاعدة ليست على إطلاقها، بل هنالك شروط لابد من اعتبارها وتقييد القاعدة بها، وهي أربعة شروط: \ 1.\ وجود مناسبة معتبرة تجمع بين الاصطلاح ومعناه. \ 2.\ ألا يكون في هذا الاصطلاح مخالفة للوضع اللغوي أو العرف العام. \ 3.\ ألا يكون في الاصطلاح مخالفة لشيء من أحكام الشريعة. \ 4.\ ألا يترتب على هذا الاصطلاح الوقوع في مفسدة الخلط بين المصطلحات. \ والقدر الجامع لهذه الشروط الأربعة هو: ألا يفضي هذا الاصطلاح إلى مفسدة، وهذه المفسدة قد تكون مفسدة لغوية أو مفسدة عرفية أو مفسدة شرعية أو مفسدة اصطلاحية. The meaning of the principle: "There is no dispute in terminology "is that if there is a disagreement on the issue of terminology no should be built on it nor should it be taken into ruling consideration . When implementing this principle it is openly seen that if agreement on the meaning of the term and a there is an its pronunciation then there disagreement on its name or this principle which must be an additional phrase added to principle is " after agreement on the meaning". Then this must not a general principle infect there are conditions which be taken into consideration whereby the principle is limited these conditions are four. .And 1 .The presence of a considerate situation which links the terminology with its meaning. 2. This terminology should not go against the basics of the language and not what is known generally. 3. There should not be in this terminology anything that goes against the Islamic Law. 4. A person should not fall into the error of mixing between the terminologies as a result of using this terminology. The general limit that gathers these four conditions are: That using this terminology should not lead to harm, This harm may be one related to the language or customary or islamically or terminologically.
