| المستخلص: | لقد تضمنت معركة الخندق التي وقعت في السنة الخامسة للهجرة أحكاماً فقهية مهمة، هي: مشروعية إنابة الإمام وجعل من ينوب عنه في غيابه لأجل قتال وغيره ومشروعية الشورى بل استحبابها للقائد والرئيس ووجوبها على النبي صلي الله عليه وسلم لذا نجد إن هذه الغزوة استشار النبي صلي الله عليه وسلم فيها مرتين مرة في حفر الخندق والثانية في إعطاء ثلث تمر المدينة لغطفان. ومشروعية المبارزة وإظهار قوة المسلمين في ساحة المعركة وتقوية معنوياتهم. ومشروعية التجسس على الكفار لمعرفة أخبارهم والاحتياط لمكرهم ليتسنى للقائد وضع الخطط المناسبة للعدو والظفر به وتقليل خسائر جنوده. ومشروعية الخديعة في الحرب والتمويه عليهم وبث الرعب بين صفوفهم ما أمكن ذلك. ومشروعية تأخير الصلاة لأجل الجهاد في سبيل الله عن وقتها وذلك للخوف من العدو. ومشروعية الترتيب بين الصلوات الفائتة كما لو كانت وقتية أي يراعى فيها الترتيب كما رتبها رب العزة. ومشروعية الأذان والإقامة للصلوات الفائتة. وجواز الحلف من غير استحلاف على أمر ديني لتأكيد هذا الأمر. وبيان حكم بيع جثة الكافر من حيث جوازها أو عدمها. مشروعية قتال من نقض العهد.
