| المستخلص: | فمن وجوه عناية الإسلام بأحكام الزوجية: ما شرعه الله تعالى في كتابه وعلى لسان نبيه صلى الله عليه وسلم من أمر اللعان، الذي يصار إليه عند قذف الرجل زوجته بالزنا وعدم تمكنه من إقامة البينة على ذلك؛ فقد بين عز وجل في خمس آيات من سورة النور ما يتعلق باللعان من أحكام وآثار. وفي هذا البحث المعنون له (أحكام اللعان في ضوء القرآن) دراسة لهذه الآيات. وقد قسمه الباحث إلى خمسة أقسام: أولها: يتناول ما ورد في سبب نزول هذه الآيات من أحاديث متعددة، يذكر في بعضها اسم الملاعن، ويترك في بعضها. وحين يذكر يختلف فيه. وفي البحث بيان وترجيح. وثانيها: يتعلق بالمناسبة بين آيات اللعان وآيات القذف قبلها؛ إذ هذه في حكم القذف عموماً وآيات اللعان في حكم قذف خاص؛ وهو قذف الرجل زوجته. وثالثها: يذكر ما ورد في آيات اللعان من اختلاف بين القراء العشرة. وهو اختلاف مرده إلى اللغة والإعراب، ولا أثر له في الأحكام الشرعية. ورابعها: يتعرض لبعض الفوائد والنكت البلاغية المستفادة من هذه الآيات، وفيها دلالة على جانب عظيم من جوانب الإعجاز القرآني؛ وهو الإعجاز البياني. أما خامسها: فخصصه الباحث لأحكام اللعان المستفادة من هذه الآيات ومن الأحاديث الواردة في شأنها. ومن ذلك: تعريف اللعان، وبيان مشروعيته. وذكر أنواعه. وشروط صحته، وصفته وألفاظه. وما يستحب له، وما يترتب عليه من الآثار في حق كل واحد من المتلاعنين، وفي حق الولد المراد نفيه ... وغير ذلك من المسائل والتفصيلات الهامة . Praise be to Allah, Pray & Peace be upon the seal of the prophets. One of aspects that Islam gives a great interest concerning marriage laws is: what Allah has decreed in the holy Quran & what our prophet has mentioned regarding imprecation person, when one accuses his wife of adultery & not managing to prove it, Allah , the Almighty has illustrated this in five verses at Sura Alnour concerning imprecation person from laws & effects. In this research which entitled "laws of imprecation person in the light of Quran" studying these verses. The researcher has divided it into five sections: The first : discussion about what have mentioned regarding reasons for reveling this verses from a lot of Islamic Traditions, some of them states name of imprecation person but some others leave it, when it is stated, they have difference about it. The research has illustration & preponderance. The second :covering adequateness between imprecation verses & defamation verses that are mentioned before them, as they are about defamation law generally, but imprecation verses about special defamation law " it is one's defamation to his wife. The third: illustrates difference between the tenths readers about imprecation verses, and this difference returns to Language & syntax, and has no relation to Islamic orders. The fourth: dealing with some advantages & rhetorical points which have been understood from this verses, and they have a great significance regarding one of Quranic miraculous aspects, it is rhetorical miraculous. The fifth :the researcher designed this section for imprecation laws that are extracted from these versus & Traditions concerning imprecation. Such as imprecation definition, displaying its legitimacy, its kinds, conditions of its verity, its quality, its utters, what is recommendable, & what follows it from influences regarding right of both imprecation persons, and child's right that they want to deny. And other cases & significant explanations. |
