| المستخلص: | تعد فترة حكم الدولة الأموية في عصري الإمارة والخلافة من أعظم الفترات التاريخية التي عاشها العرب في الأندلس وبالرغم من ذلك تعرضت البلاد في تلك الفترة لكثير من الفتن والثورات لذلك أصبح لزاما على السلطة الحفاظ على الدولة وهيبتها من خلال تطبيق العقوبات المختلفة على الثائرين ومن بينهما عقوبة التشهير. يتناول هذا البحث عقوبة التشهير في الأندلس في عصري الإمارة والخلافة وهي فترة مليئة بالأحداث والتطورات على كافة النواحي السياسية والاقتصادية والاجتماعية. لذلك تعددت الأوجه والأسباب التي أدت إلى هذه العقوبة فمنها أسباب سياسية واقتصادية واجتماعية ودينية، وقد قسمت البحث إلى عدة نقاط. 1-التشهير لغة واصطلاحا 2-الأسباب التي أدت إلى التشهير 3-أدوات التشهير 4-من المسئول عن تطبيق عقوبة التشهير؟ The period of rule of the Umayyad state in the eras of the emirate and the caliphate is considered one of the greatest historical periods that the Arabs experienced in Andalusia. Despite this, the country was exposed during that period to many strife and revolutions. Therefore, it became necessary for the authority to preserve the state and its prestige by applying various punishments to the rebels, including the punishment of defamation. This research deals with the punishment of defamation in Andalusia during the Emirate and Caliphate eras, a period full of events and developments in all political, economic and social aspects. Therefore, there were many aspects and reasons that led to this punishment, including political, economic, social and religious reasons. I divided the research into some points: 1-Defamation, language and terminology 2-The reasons that led to defamation 3-Defamation tools 4-Who is responsible for applying the penalty of defamation |
