| المستخلص: | لعل من أبرز الظروف الاقتصادية التي طرأت في السنوات الأخيرة، وأثرت على تنفيذ العقود الإدارية، لجوء الحكومة إلى تحرير سعر صرف الجنيه المصري مقابل العملات الأجنبية؛ فقد ترتب على ذلك ارتفاع أسعار مواد البناء من حديد وأسمنت وغيرها، وكذلك ارتفاع كافة أسعار السلع المستوردة والمحلية، مما أثر على التوازن المالي لكثير من العقود المبرمة مع الجهات العامة، فهذا الإجراء أدى إلى تعثر المتعاقدين مع الإدارة، وتأخرهم في تنفيذ العقود، وتكبدهم خسائر بالغة، وقد حدث ذلك في أعوام 2003 و2016 و2022. من هنا يأتي هذا البحث معنونا بـ "أثر تحرير سعر الصرف على التوازن المالي للعقد الإداري"، ومجيء العنوان على هذا النحو، يطرح تساؤلا على قدر كبير من الأهمية مؤداه: هل تحرير سعر صرف العملة (تعويم الجنيه المصري) يعد من قبيل الظروف الاقتصادية الطارئة، التي توجب على الجهة الإدارية المتعاقدة تعويض المتعاقد عنها، حتى يعود للعقد الإداري توازنه؟ هذا هو التساؤل الرئيسي الذي ستدور حوله صفحات هذا البحث.
