| المستخلص: | أثار موضوع تعويض الشخص المعنوي عن الضرر المعنوي نقطة خلاف بين مجتمع الفقه القانوني لفترة زمنية طويلة، وذلك مرده لشخصية الشخص المعنوي القانونية وألية اكتسابها وطبيعتها، ولكون أغلب قوانين الدول قد غلقت باب المطالبة القضائية بالتعويض عن الضرر المعنوي للشخص المعنوي أمامه، فلا نجد نصا قانونيا في القانون العراقي يسعف المناديين بحق الشخص المعنوي بتعويض الضرر المعنوي، ولو تدرجنا في متابعة النهج المتبع من قبل القضاء العراقي نجد بأنه يدعم التشريع العراقي بل أنه يأبى الخروج من دائرة رفضه لهذا التعويض. لا بد لنا في هذا البحث من تبيان مفهوم الضرر المعنوي الذي يطالب البعض بالتعويض عنه إذ أصاب الشخص المعنوي بالاستناد إلى الاتجاه القانوني المتبع في القانون والقضاء العراقي، ليستوقفنا توجه التشريع الفرنسي الجديد صوب تعويض الشخص المعنوي والأدلة التي استند عليها، لتطرح الباحثة في مجمل ما استنتجته من طروحات البحث نتائج ورأي قد يجانب الصواب في ظل التطورات المتسارعة في الحياة العملية وأهمية الشخص المعنوي في جميع نواحي الحياة اليومية. The issue of compensating the legal person for moral damage has raised a point of contention among the legal jurisprudence community for a long period of time, due to the legal personality of the legal person and the mechanism of its acquisition and nature, and because most of the laws of the countries have closed the door for judicial compensation for moral damage to the moral person in front of him, we do not find a legal text in Iraqi law assists those who advocate the right of a legal person to compensate for moral damage. If we follow the approach followed by the Iraqi judiciary, we find that it supports the Iraqi legislation and even refuses to leave the circle of its rejection of this compensation. In this research, we must clarify the concept of moral damage that some demand compensation for if the moral person is injured, based on the legal trend followed in the Iraqi law and judiciary, so that we are stopped by the new French legislation’s direction towards compensation for the moral person and the evidence on which it was based, to put the researcher in the totality of what she concluded Among the research proposals are results and an opinion that may go astray in light of the rapid developments in practical life and the importance of the moral person in all aspects of daily life. |
