| المستخلص: | إن مراد الشارع ومقصوده من النص هو الغاية العظمى التي بذل العلماء طاقتهم في الوصول إليها، وأفرغوا وسعهم في الحصول عليها، وبما أن النص يشتمل على ألفاظ ومعاني؛ لذا لزم على كل من رام فهم مراد الشارع من النص إدراك الألفاظ والمعاني المتعلقة به، وعدم الجمود على ألفاظه فقط؛ فإن فقه المعاني أوسع إطارا وأشمل ميدانا من فقه اللفظ؛ إذ إنه يعتمد على روح النص ومقصده، من هنا وسع علماء الأصول أفق النظر في النص، ولم يركنوا إلى الظواهر دون أن يغوصوا فيما خفي فيها من أسرار، ويتطلعوا إلى العثور على ما كمن فيها من أغوار، ولم ينظروا إلى النص بما ينطوي عليه من أحكام نظرة جامدة منحصرة في مدلوله اللغوي الظاهر، غير مدركة لما يتضمنه من معان كامنة، وعلل مستنبطة وإنما نقبوا فيما يحويه من معان تخصص عامه، أو تقييد مطلقه، أو غير ذلك، سواء كانت هذه المعاني تستنبط من نفس النص أو من نص أخر، ولقد جاء هذا البحث ليميط اللثام عن مسألة تتعلق بتخصيص النص العام بالمعنى المستنبط منه، مبينا المقصود بتخصيص النص العام بالمعنى المستنبط منه، وأنواع المعاني المستنبطة، وآراء الأصوليين في تخصيص النص العام بالمعنى المستنبط منه، وشروطه، وما نشأ عن الاختلاف فيه من اختلاف في الفروع الفقهية. The Lawgiver's intent and purpose from the text is the greatest goal that scholars have exerted their energy to reach, and devoted their effort to obtaining, and since the text contains words and meanings, it is necessary for everyone who seeks to understand the Lawgiver's intent from the text to be aware of the words and meanings related to it, and not to be stuck on its words. Just; The jurisprudence of meanings is broader in scope and more comprehensive in field than the jurisprudence of pronunciation. As it depends on the spirit and purpose of the text, hence the scholars of fundamentals broadened the horizon of looking at the text, and did not rely on the phenomena without delving into what is hidden in it of secrets, and looking forward to finding the hidden depths in it. They did not look at the text with the rulings it contained from a rigid viewpoint confined to its apparent linguistic meaning, unaware of the latent meanings it contains and deduced reasons. Rather, they delved into what it contained in terms of general specific meanings, or absolute restriction or otherwise, whether these meanings were deduced from the soul. The text or from another text, and this research came to uncover an issue related to the specification of the general text with the meaning deduced from it, explaining what is meant by specializing the general text with the meaning deduced from it, the types of meanings deduced, and the opinions of the Fundamentalists in Personalizing the general text with the meaning deduced from it, its conditions, and what emerged from it. The difference in it comes from differences in the branches of jurisprudence. |
