| المستخلص: | تتمثل مشكلة البحث في الغموض الذي يكتنف النصوص التي تضمنها قانون الأحوال الشخصية اليمني التي نظمت هذا الموضوع، وذلك من شأنه أن يلقي بظلاله على القضاة والمحكمين والمحامين والباحثين فيما يواجهون من قضايا النفقات وتقديرها، مما يستلزم البحث والتدقيق في أقوال الفقهاء واجتهاداتهم، بغية الوصول إلى المطلوب لمعالجة ما يعترضهم من قضايا. ولذلك فالبحث يزيل كثيرا من هذا الغموض، كما أنه يوضح مواطن القصور القانوني، ويهدف إلى بيان الشروط والضوابط اللازمة في تقدير نفقة الزوجة، والتي أغفل القانون الكثير منها. وفي ضوء هذا كله يقدم التوصيات المناسبة لمعالجة الإجمال والغموض في النص القانوني. The research problem is the ambiguity that surrounds the texts of the Yemeni Personal Status Law, which regulated this subject. This ambiguity could cast a shadow over judges, arbitrators, lawyers, and researchers when dealing with maintenance and estimation cases. It necessitates research and scrutiny of the opinions of jurists and their interpretations to arrive at the solutions required to address the cases they encounter. Therefore, the research eliminates much of this ambiguity, clarifies legal deficiencies, and aims to specify the necessary conditions and controls in estimating the wife's maintenance, many of which the law has largely overlooked. In light of all these aspects, it provides appropriate recommendations to address the comprehensiveness and ambiguity in the legal text. |
