| المستخلص: | ان الغاية من العقوبة هي جزاء للجاني عن الفعل المرتكب، وزجر او ردع للغير، لكن ان تلك العقوبات يقابلها جزاءات قد تختلف من جريمة عن أخرى، فان كل شخص يرتكب جريمة يتم مسح ميداني له وكذلك جلب صحيفة سوابق المتهم قبل النطق بالحكم، والتأكد من سلوكه، لذا فان الغاية من العقوبة الحد من تكرار مثل تلك الجرائم في المجتمع، بغية الحد من تلك الجرائم لذا قد تقضي الضرورة الى توجيه عقوبات بديلة أخرى مقيدة للحرية، والمتمثلة بأعمال أخرى غير سالبة للحرية، مثل أي عمل شاق او قد تكون بأعمال خارج السجن، والتي تكون وفق مصطلح الافراج الشرطي أي قد يكون تحت المراقبة سلطة القانون وسطوتها، ربما يكون الهدف من الاخذ بفرض مثل تلك العقوبات قد يكون هدفها واضح هو اصلاح المحكوم، وكذلك التخوف من ان تؤثر تلك العقوبات على نفسية الشخص المحكوم، وكذلك قد تضر في سمعت عائلته، لذا فان الغاية من فرض مثل تلك العقوب البديلة، هي اصلاح الذات وكبح جماح الغير، لما لها من مردود سلبي على الشخص المحكوم خاص الشخص الذي ليس لدية سوابق، من اجل إعطاء فرص له من اجل اصلاح.
