| المستخلص: | تبين هذه الدراسة بعنوان: (التكييف الفقهي للأعضاء الصناعية المزروعة) حكم الأعضاء الصناعية المزروعة في جسد الإنسان، وذلك من خلال ما يلي: التمهيد: في بيان ماهية زراعة الأعضاء الصناعية، وحدود البحث. وتهدف هذه الدراسة إلى مناقشة التأصيل العلمي والفقهي للأعضاء الصناعية المزروعة في البدن، من حيث حالاتها، وأقوال الفقهاء -رحمهم الله- في حكمها، والاستدلال لكل قول من الأقوال، وبيان سبب الخلاف في إلحاقها بالأعضاء الأصلية أو الزائدة، والتدليل على هذا الإلحاق من أربعة عشر وجها، وما يترتب على ذلك من آثار فقهية كغسل العضو الصناعي في الطهارة، وتعليق الطلاق والظهار عليه، وعدة الزارعة لرحم صناعي، وطلاق السنة والبدعة في حقها، وحكم الدم الخارج من الرحم الصناعي، ثم مناقشة أدلة المعارضين والإجابة عنها. الخاتمة: وفيها خلاصة البحث. منهج البحث - مراعاة المنهج المتبع في البحوث العلمية. - التمهيد ببيان ماهية زراعة الأعضاء الصناعية. - مناقشة التكييف الفقهي للأعضاء الصناعية المزروعة، ودراسة مسائله دراسة مقارنة، مع الاستدلال والترجيح. أهم النتائج: - اختلف الفقهاء في إلحاق الأعضاء الصناعية الظاهرة بالأصلية على قولين. - سبب الخلاف بين الفقهاء في اعتبار الأعضاء الصناعية كالأصلية، مبني على: إلحاق العضو الصناعي بالعضو الأصلي أو الزائد؟ - الأعضاء في إطلاق الفقهاء تنقسم إلى: العضو الأصلي، والعضو الزائد. والأصلي ينقسم إلى: متصل ومنفصل. - يترجح أن الأشبه لحوق العضو الصناعي المزروع في الجسد بالعضو الزائد، فيختلف حكمه من حيث الاتصال والانفصال باختلاف الأحكام الفقهية. This study (Jurisprudential Classification for the Artificial Organs Transplantation) shows transplanted artificial organs Jurisprudence through the following: Abstract: In explaining what is the essence of artificial organs transplantation, research limits. This Study aims to discussing the scientific & Jurisprudential rooting of transplanted artificial organs within human body, as condition, jurist's opinions and proof each one, show the reason of disagreement in attaching them to the original or extra organs, and proof this disagreement by fourteen ways, and the consequent jurisprudential implications as washing artificial organ and holding divorce, artificial uterus transplantation Iddah "period of waiting", provision of blood that out of artificial uterus, the researcher discussed the opponents proofs and its answer. Conclusion: included the research results. The Research Approach: - Based on the applied approach of scientific researches. - Introduction to show the importance of Artificial Organs Transplantation. - Discussing of Jurisprudential Classification for the Artificial Organs Transplantation, studying matters as comparative study, with proof & weighting. Most Important Results: - Jurists had two different arguments regarding the connectivity of artificial organs to the original. - The reason behind the differences among the jurists in considering artificial organs like the original is built on the connectivity of that artificial organ to the original or extra organs. - Jurists have classified the organs into two main categories: Firstly, the original organ can be either connected or separated. Secondly, the extra organ. - Following the similarity measurement rule, it is more likely that artificial organs implanted in the body will follow the extra organ in the jurisprudence. As the connectivity and disconnectivity will depend on the jurisprudence. |
