| 520 | |a إفهام السامع بمعنى قول خليل في النكاح بالمنافع أو (النكت اللوامع بمعنى قول خليل في النكاح بالمنافع) تأليف: أحمد بابا بن أحمد بن أحمد التنبكتي (ت 1036ه) تحقيقا، ودراسة. فهذا تحقيق، ودراسة لمخطوط في الفقه المالكي بعنوان: (إفهام السامع بمعنى قول خليل في النكاح بالمنافع، أو النكت اللوامع في مسألة النكاح بالمنافع)، من تأليف العلامة: أحمد بابا التنبكتي المالكي (ت 1036ه)، بعد وقوفي على أهميتها، وحصولي على ثلاث نسخ منها، ولكونها لم تحقق من قبل، ولعالم متبحر في العلوم الشرعية، والفقه خاصة، وقد جاءت الرسالة نفيسة في موضوعها، ومضمونها، وخادمة للمختصر الفقهي المالكي المعتمد في دراسة المذهب، وهو مختصر خليل. وقد اختار المؤلف هذه المسألة من المختصر ليحل بذلك عدة إشكالات؛ منها أنها وردت في مختصر خليل بقولين من غير ترجيح، ومن منهج الشيخ خليل إذا كان في المسألة قول مشهور اكتفى به، وقد اختار في كتابه التوضيح شرح جامع الأمهات لابن الحاجب القول الذي شهره ابن الحاجب، وتبعه عليه تلميذه بهرام، ولم يكتف بهذا القول في مختصره، فناقش ذلك، كما أجاب المؤلف عن اكتفاء الشيخ خليل بقولين من الأقوال الخمسة في المسألة، ثم ذكر المؤلف هذه الأقوال من الكتب المعتمدة في المذهب، وليس منها القول الذي شهره ابن الحاجب، وإنما هو قول سادس في المسألة، فاحتاج ذلك إلى التحرير، والبيان، وبنين المؤلف معنى نص الشيخ خليل في هذه المسألة بيانا مفصلا، وذكر فوائد نفيسة، جديرة بالعناية، يتعلق بعضها بنص العبارة، وأخرى بمختصر خليل، وأفضل شراحه إلى زمانه، فجاءت هذه الرسالة ذات قيمة علمية متميزة في الفقه المالكي، وخادمة لمختصر خليل، الذي عليه الاعتماد في دراسة المذهب. |b Making the listener Understanding the Meaning of Khalil’s saying in marriage with benefits or (Alnakt Allawamie in the Meaning of Khalil’s Saying in Marriage with Benefits) authored by: AHMED BABA BIN AHMED BIN AHMED AL-TANBAKTI (Dead on: -1036H). Investigation and study. This is an investigation, a study of a manuscript treatise in AlMaliki jurisprudence entitled: (Making the listener Understanding the Meaning of Khalil’s saying in marriage with benefits or (Alnakt Allawamie in the Meaning of Khalil’s Saying in Marriage with Benefits), authored by the scholar: AHMAD BABA AL-TANBAKTI AL-MALIKI (dead on 1036H ). After I recognized its importance, and obtained three copies of it, because it had not been verified before, for a scholar who delved into legal sciences, and jurisprudence in particular. The Study was precious in its subject and content, a servant of ALMaliki jurisprudential summary adopted in the study of the doctrine, which is the summary of Khalil. The author chose this issue from Al-Mukhtasar to solve several problems. Including what mentioned in the summary of Khalil with two sayings without weighting, and from the approach of Sheikh Khalil if there is a famous saying in the matter, he sufficed with it, he chose in his book the Explanation, the explanation of (JAMIE ALAMHAT) by Ibn Al-Hajib, the saying that Ibn Al- Hajib famous, and his student Bahram followed him, he did not suffice with this saying in Briefly, discuss that, as the author answered that Sheikh Khalil was satisfied with two of the five sayings in the matter, then the author mentioned these sayings from the approved books in the doctrine, and not among them is the saying that Ibn Al-Hajeb famed it , but it is a sixth saying in the issue, so this needs to be edited, statement, and the author explained the meaning of Sheikh Khalil’s text on this issue in a detailed explanation, mentioned precious benefits worthy of attention, some of which relate to the text of the phrase, and others to Khalil’s summary, and the best explanations of it to his time. So this Study came with a distinct scientific value in Al Maliki jurisprudence, and a servant to Mukhtasar Khalil, who has to rely on the study of the doctrine. | ||
