| 520 | |a تناولت هذه الدراسة موضوع "دور الهيئة الوطنية للانتخابات المعاصر للعملية الانتخابية"، من أجل تحديد مدى اهتمام المشرع بهذه العملية وهي أحد أعمدة الديمقراطية لأي نظام سياسي، الهدف الرئيسي من هذا البحث هو محاولة معرفة الدور الذي يمكن أن تلعبه الهيئة الوطنية للانتخابات في إجراء انتخابات نزيهة من خلال إدارة العملية الانتخابية بأكملها، ولا سيما إجراء الانتخابات الأولى تحت إشراف الهيئة الوطنية للانتخابات لعام ٢٠١٧. وما هو دور الأجهزة المعنية في إدارة العملية الانتخابية وقد كان الهدف في المبحث الأول هو الإلمام بدور الهيئة الوطنية للانتخابات المعاصر للعملية الانتخابية ومن خلال هذا المبحث تعرضنا في المطلب الأول عن مرحلة الإعلان والترشح سواء في الانتخابات البرلمانية (نواب -شيوخ)، أو في الانتخابات الرئاسية، وفي المطلب الثاني تعرضنا لمرحل الدعاية الانتخابية وحجم الإنفاق في الدعاية للانتخابات الرئاسية والبرلمانية، وفي المطلب الثالث تعرضنا لتجهيز المقرات وإجراءات الاقتراع كل ذلك من خلال عرض النصوص القانونية والآراء الفقيهة وأحكام القضاء من اجل الإلمام بالموضوع بكافة جوانبه. وما يمكن استخلاصه من هذه الدراسة: تعتمد نزاهة وشفافية الانتخابات على استقلالية أولئك الذين يشرفون على إدارة العملية الانتخابية لأن مصداقيتهم تتطلب الاستقلالية وتمتعهم بالضمانات الحقيقية. |b This study addressed the theme of "the role of the National Electoral Commission contemporary of the electoral process", in order to determine the extent to which the legislator is interested in this process, which is one of the pillars of democracy for any political system, the main objective of this research is to try to find out the role that the NATIONAL Electoral Commission can play in holding fair elections by managing the entire electoral process, in particular holding the first elections under the supervision of the National Electoral Commission for 2017. What is the role of the relevant agencies in the management of the electoral process, and the goal in the first discussion was to be familiar with the role of the National Electoral Commission in the contemporary electoral process and through this research we were exposed in the first demand about the stage of advertising and candidacy, whether in the parliamentary elections (deputies- elders) or in the presidential elections, and in the second demand we were exposed to the stage of electoral propaganda and the volume of spending in the propaganda of the presidential and parliamentary elections, and in the third demand we were exposed to the processing of headquarters and voting procedures all through the presentation of the electoral propaganda and the volume of spending in the propaganda of the presidential and parliamentary elections, and in the third demand we were exposed to the process of headquarters and voting procedures all through the presentation of Legal texts, jurisprudential opinions and judicial rulings in order to be familiar with the subject in all its aspects. What can be drawn from this study: the integrity and transparency of elections depend on the independence of those who oversee the management of the electoral process because their credibility requires independence and their enjoyment of real guarantees. | ||
