| المستخلص: | نظرا لحرمة جسم الإنسان وضرورة الحفاظ على سلامته، عملت جل التشريعات جاهدة لحمايته من مختلف الاعتداءات التي قد تقع عليه، وفي نفس الوقت مواكبة التطور العلمي والتكنولوجي خاصة في المجال الطبي، وبالتالي نجد إباحة سلوكيات تفرضها الضرورة، وبالمقابل تكريس كل الوسائل لإضفاء حماية كافية لجسم الإنسان؛ أهمها الحماية الجنائية. وبالتالي، تعتبر جميع الأفعال المنافية جريمة يحاسب عليها الطبيب متى توافرت شروطها، كما أن مسؤولية الطبيب بصفة عامة تكتسب أهمية في هذه العمليات وذلك لاعتبارين: الأول أنها تتعلق بحماية جسده وسلامته؛ والثاني من خلال العمل الطبي الموكل له، وعليه فإن المسؤولية الجزائية قد تلحق الطبيب نتيجة لذلك باعتبار أن الطبيب يقوم بعمل غير مشروع أو مخالف للقواعد القانونية التي تنظم هذه العمليات ويعرض نفسه لعقوبات جزائية. In view of the sanctity of the human body and the need to preserve its safety, most legislations have worked hard to protect it from the various attacks that may occur on it, while at the same time keeping abreast of the scientific and technological development, especially in the medical field. Therefore, we find permissive behaviors imposed by necessity and in return devoting all means to give adequate protection to the human body, Most notably criminal protection. Therefore, all acts of contributory offense are considered a crime to be held accountable by the doctor when the conditions are met, and the responsibility of the doctor in general is important in these operations, considering : the first it concerns the protection of his body and safety; and second through the medical work entrusted to him, As a result of the doctor doing illegal work or contrary to the legal rules governing these operations and introduces himself to penal sanctions |
