| المستخلص: | عرضت في هذا البحث لحقوق كبير السن في الثقافة الإسلامية من خلال عناية الشريعة الإسلامية بكبير السن، حيث جاءت بحقوق خاصة لكبير السن بدلالة القرآن الكريم والسنة النبوية. وكذلك عرضت لأحدث نظام معاصر في مجال حقوق كبير السن مبني على الشريعة الإسلامية، وهو نظام حقوق كبير السن ورعايته في المملكة العربية السعودية الذي اعتنى بحقوق كبير السن ورعاية المحتاج منهم، وقد نص على حقوق متنوعة لكبير السن، سواء كانت حقوقا شرعية أم نظامية، بما في ذلك حقوقه المالية والجسدية والاجتماعية والمعنوية. ومن خلال مقارنات ثقافية تحليلية بين ما سبق وما صدر من مواثيق دولية في مجال حقوق الإنسان عموما، وكبير السن خصوصا، تبين من خلال هذا البحث أن حقوق كبير السن لم تحظ باهتمام واسع في المواثيق الدولية، بل إن حمايتها والعناية بها ضعيفة مقارنة بالاهتمام الكبير بفئات أخرى. ويتبين بذلك تميز الثقافة الإسلامية وسبقها في حقوق كبير السن، إضافة إلى جماليات التشريعات الإسلامية وكمالها، وتميز وعدالة ما بني عليها من أنظمة كنظام حقوق كبير السن ورعايته في المملكة العربية السعودية. In the field of law, Islamic culture takes care of the rights of the elderly. The provisions of the Holy Quran and the Sunnah emphasize various aspects of care and rights. The latest contemporary law in the field of the rights of the elderly is built on them: the law of the rights of the elderly and their care in the Kingdom of Saudi Arabia. This law took care of the rights of the elderly and the care of the needy. It stipulated various rights for the elderly, whether they were sharia or legal rights, including financial, physical, social, and moral rights. This research aims to clarify the rights of the elderly in Islamic culture through legal provisions and the articles of the law on the rights of the elderly and their care in the Kingdom of Saudi Arabia, as well as highlight the distinction of Islamic culture and its precedence in determining the rights of the elderly. The research used a comparative analytical approach based on international conventions in the field of human rights in general and the elderly in particular. The main findings of this research indicate that the rights of the elderly did not receive wide attention in international conventions, but rather that their protection and care are weak compared to the great interest in other groups. Islamic culture is distinguished and preceded in the field of the rights of the elderly, in addition to the perfection of Islamic legislation. It is also distinctive and fair in terms of the rights of the elderly and their care in the Kingdom of Saudi Arabia. |
