| 520 | |a تعتبر السلطة القضائية الركيزة الأساسية لمعظم الأنظمة الدستورية ومنها النظام الدستوري الجزائري، حيث عملت الجزائر منذ 1962 على تطوير السلطة القضائية من كل الجوانب إلى غاية دستور 2020. إن توافر ضمانات متعلقة باستقلالية القاضي يعزز وجود استقلال حقيقي وكامل للقضاء ويضمن حرية القضاة في إبداء آرائهم فهي تتعلق بمدى تطبيقهم للقواعد القانونية التي يحرصون على تطبيقها. فاستقلال القضاء مبدأ أساسي في كل المجتمعات الديموقراطية وهو من المبادئ القضائية التي تم تكريسها عالميا باعتباره أهم ضمانة لحماية حقوق الأشخاص وحرياتهم وحتمية ضرورية لاستقرار المجتمعات. |b The judicial authority is the main pillar of most constitutional systems, including the Algerian constitutional system, as Algeria has worked since 1962 to develop the judicial authority in all aspects until the 2020 constitution. The availability of guarantees related to the independence of the judge enhances the existence of real and complete independence of the judiciary and guarantees the freedom of judges to express their opinions, as it is related to the extent of their application of the legal rules that they are keen to implement. The independence of the judiciary is a fundamental principle in all democratic societies, and it is one of the judicial principles that have been enshrined globally as the most important guarantee for the protection of people's rights and freedoms and a necessary imperative for the stability of societies. | ||
