| المستخلص: | يخضع عقد هبة العقار لإجراء الشهر العيني لإتمام نقل ملكية العقار الموهوب المستوفي لإجراء المسح العقاري إلى الموهوب إليه، ويرتب الشهر العيني أثره الناقل ليس فقط في مواجهة إرادة طرفي العقد المتجسدة من خلال العقد التوثيقي بل حتى في مواجهة الغير، غير أن المشرع الجزائري استثنى من مبدأ الأثر الناقل للشهر العيني حالة العقد التوثيقي المشهر بعد الوفاة، فتنتقل ملكية العقار الموهوب بموجب العقد التوثيقي في حال وفاة الواهب قبل شهر العقد ابتداء من تاريخ الوفاة، ولا يعتبر تصرف الواهب المتوفى قبل شهر العقد تصرفا مضافا لما بعد الموت، في حين فتح المشرع الجزائري المجال للطعن في صحة عقد هبة العقار المشهر نظرا لعدم أخذه بالأثر المطهر للشهر العيني.
