| المستخلص: | إن الغرض من السياسة الجنائية هو تحقيق التوازن بين مقتضيات حق الدولة في العقاب، ومنع الجرائم بهدف حماية الأمن والمصلحة الاجتماعية وبين حقه في الحرية ذلك أن الدولة بحكم وظيفتها يقتضي عليها حماية المصالح القانونية المعتبرة كافة، كون توفير الأمن الاجتماعي غاية قصوى، وهدف أسمى تسعى إليه المجتمعات الإنسانية كافة من خلال تطبيق القانون الجنائي، كوسيلة من بين الوسائل المختلفة الرامية إلى تحقيقه بما ينسجم مع مختلف الظروف التي تساهم في تهديد وتعكير صفوه، ولا ريب أن المشرع يسعى عند وضعه لأطر السياسة الجنائية إلى تحقيق ذلك المبتغى، خصوصا أن لظاهرة المخدرات وتوسعها أبعادها السياسية والاجتماعية والاقتصادية، وذلك على اعتبار أن هذه المخدرات هي لا تنتج في داخل العراق، الأمر الذي يتسبب بخروج موارد مالية كبيرة جدا من الدولار إلى خارج العراق لتوريد هذه المواد المخدرة، أيضا لها أبعاد ثقافية على المجتمع وذلك من خلال حالتها التدميرية والخطرة على الفرد والمجتمع، ومن ثم كل المجتمعات لا تسمح بهذه الظاهرة إلا بالحدود المسموح بها، خاصة فيما يتعلق بالجوانب الطبية والعلاجية. The purpose of the criminal policy is to achieve a balance between the requirements of the state's right to punish and prevent crimes in order to protect security and social interest and its right to freedom, because the state, by virtue of its function, requires it to protect all legal interests considered, since providing social security is a paramount goal, and a higher goal it seeks. All human societies through the application of the criminal law, as a means among the various means aimed at achieving it in line with the various circumstances that contribute to threatening and disturbing its peace, and there is no doubt that the legislator, when setting the frameworks for criminal policy, seeks to achieve that goal, especially since the phenomenon of drugs and its expansion has dimensions Political, social and economic, given that these drugs are not produced inside Iraq, which causes the exit of very large financial resources from the dollar outside Iraq to supply these narcotic substances, and also has cultural dimensions on society, through its destructive and dangerous condition for the individual and society, and then all societies do not allow this phenomenon except within the permissible limits, especially with regard to the medical and therapeutic aspects. |
