| المستخلص: | لقد عرف النظام القضائي الإداري الجزائري العديد من الإصلاحات عبر مختلف التعديلات الدستورية، ولعل أبرزها إعلان المؤسس الدستوري عن إنشاء محاكم إدارية للاستئناف بموجب التعديل الدستوري لسنة 2020، والتي تعتبر خطوة هامة لتكريس دولة الحق والقانون وحماية الحقوق والحريات. وبهذه الخطوة يكون المشرع قد أكمل هياكل النظام القضائي الإداري والذي أصبح يتشكل من ثلاث مستويات المحاكم الإدارية في القاعدة وتعلوها المحاكم الإدارية للاستئناف ومجلس الدولة في قمة الهرم القضائي الإداري. تهدف هذه الدراسة إلى تسليط الضوء على الأساس القانوني للمحاكم الإدارية للاستئناف وهيكلتها وتشكيلتها، بالإضافة إلى دراسة اختصاصاتها في ظل التعديلات القانونية التي مست المنظومة القانونية الخاصة بالمنازعة الإدارية. The Algerian administrative judicial system has known many reforms through various constitutional amendments, perhaps most notably, the constitutional founder’s announcement of the establishment of administrative courts of appeal under the constitutional amendment of 2020, which is a qualitative leap to enshrine the state of the right and the law. Thus the structures of the administrative judicial system, which now consists of the conseil d’état, administrative courts of appeal and administrative courts, have been completed and have become more in line with its ordinary judicial counterpart, this study aims to highlight the legal basis and structure of the administrative courts of appeal, as well as to study their competencies under the legal amendments of the legal system of administrative disputes. |
