| المستخلص: | أكدت الأديان السماوية والقوانين الوضعية أن ذوي الاحتياجات الخاصة ورعايتهم تعتبر من المسائل الجديرة بالاهتمام. وقد سبقت الشريعة الإسلامية الأمم في إرساء منظومة حقوقية متكاملة تتعلق بهذه الفئة، فكان الأساس التشريعي الذي ألهم التشريعات الوضعية للتكريس القانوني لحقوق ذوي الاحتياجات الخاصة وإلزامية المحافظة عليها ورعايتها. وقد أولى المجتمع الدولي عناية كبيرة بذوي الاحتياجات الخاصة، وهذه العناية أخذت نسقا تصاعديا من أجل إرساء منظومة حقوقية تتلاءم مع وضعيتهم الصحية والنفسية صونا لكرامتهم وحفظا لإنسانيتهم. كما أن القانون التونسي يزخر بالتشريعات التي تضمن حقوق ذوي الاحتياجات الخاصة، إلا أن هذه القوانين لا ترتقي إلى مستوى آمالهم، كما أن هناك خلل على مستوى التطبيق العملي للقوانين المتعلقة بدمجهم في الحياة اليومية والاجتماعية من تعليم، وصحة، ونقل. Revealed religions and man-made laws have confirmed that people with special needs and their care are considered issues worthy of attention. Islamic Sharia preceded nations in establishing an integrated human rights system related to this group. It was the legislative basis that inspired positive legislation to legally enshrine the rights of people with special needs and the obligation to preserve and care for them. The international community has paid great attention to people with special needs, and this care has taken an escalation in order to establish a human rights system that is compatible with their health and psychological conditions in order to preserve their dignity and preserve their humanity. Tunisian law is also full of legislation that guarantees the rights of people with special needs, but these laws do not live up to their expectations, and there is a defect in the practical application of the laws related to their integration into daily and social life, including education, health, transportation... |
