| المستخلص: | تناول هذا البحث معنى الوسطية والاعتدال ومدى ارتباطها بمقاصد الشريعة من تحقيق المصالح ودرء المفاسد وكيف عالج الإسلام جميع نواحي الحياة باتخاذ الوسطية القائمة على العدل، مما أدى إلى سهولة تناوله وقبوله عبر الأزمان، وملائمته لكل مكان، وتتجلى الوسطية وما تحويه من اعتدال في العبادات إذ راعت أصحاب الأعذار فخففت عليهم، وراعت مستوياتهم فدرجت أحكامها واستوعبت أحوال الناس في معاملاتهم فلم تكلف إلا قادراً ولم تحاسب إلا عاقلاً، وتجلت مرونتها في الوسائل والأساليب، وثباتها في عقيدتها وأخلاقها، ومحاربتها لكل ما يفسد كيانها أو يزعزع أركانها، بفرض عقوبات تلائم أصناف الناس وما تحويه أنفسهم من جرائم، فأعطت كل ذي حق حقه، وأنصفت كل مظلوم، فاستحقت أن تكون شريعة الله الخالدة. للمقاصد الشرعية مساس مباشر بحياة الناس لذلك تعد أهم العلوم وأفضلها، فهي الميزان الذي يعرف به الحق من الباطل. This research studies the meaning of "Moderation & justness" and how much it is linked to purposes and objectives of the Islamic law, aiming for achieving societies' interests and avoiding misleading actions, as it also studied how Islam cured all aspects of life by applying moderation, which is based on fairness, which by that made it easier for people to accept it and live with it at all times on all occasions, fulfilling god's will in the Quran: {And thus we have made you a just community} [Al-Bakara: 143]. Moderation and the meanings, which it carries with it, of justness and fairness in worships and prayers, has always taken into account people with excuses, so it made it easier for them to apply and do what they have as duties, it also taken into its account the differences in people's intelligence and acceptance levels, so it established its judgments and orders gradually. It's also contained people's daily life conditions, so it never obligated someone except who can do what they are obligated to do, as it's never held someone accountable for not doing what they are ordered to do if they are with mental issues. It showed a lot of flexibility in its ways and techniques, while showing stability in its doctrine and ethics, and fighting against everything that might weaken it or disturb its pillars, by imposing sanctions that fit categories of people and what crimes and sins they contain, so it's given everyone's their rights, and faired every oppressed person, which made it worthy of being god's immortal law. The legitimate purposes have a direct impact on people’s lives, so it is one of the most important and best sciences, as it is the scale by which truth is known from falsehood. |
