| 520 | |a غالب أحكام الشريعة الإسلامية معللة بمصالح جاءت لنفع العباد في إصلاح دنياهم وسلامة آخرتهم، وبالوقوف على هذه العلل وفهم أوصافها وتحديدها، يمكن القياس على أحكام النصوص، وإلحاق الأحكام المستجدة بها، وقد تقتضي مصلحة التشريع أن يكون للحكم الواحد أكثر من وصف أو شرط لا بد من توافرها، فتتركب معا لتتميم علته أو لتحقيقها؛ لأن الاقتصار على التعليل بعلة واحدة قد لا يحقق مقصد الشرع من تشريع الحكم ونفي الحرج عن الناس، فيرهق المكلفين وينافي مقاصد الشريعة. وهذه المسألة مهمة ولم تعط حقها من قبل، فدرسها الباحث عند الأصوليين والفقهاء، ثم عمل على صياغتها وترتيبها، وبين مفهوم العلة والتعليل، وشروطهما، وما يقرب منهما من معان، ووضح المقصود بالوصف المركب وحجيته لدى علماء الأصول، ثم انتقل إلى المجال العملي التطبيقي بذكر بعض أمثلة الأوصاف المركبة في التطبيقات الفقهية المعاصرة؛ لزيادة التوضيح والبيان من خلال التطبيق العملي. |b prevailing of Islamic Law provisions are justified identity of interests Legislated to helpful the people by reform their life in this world and safety of their hereafter, And by knowledge this causes and understanding its description and limitation it, Maybe deduction by analogy on it, And appending the recent laws to it. This issue is important and was not given its due before, so the researcher studied it according and compare researching between fundamentalists and scholars have, and then worked on wording and arranging it, This discussion is demonstrates the Meaning of the cause and the Justification, and the meant from the assembled Description, and conclusion of The learned Principles of jurisprudence the laws by it. And it will mention some of its examples in the contemporary of Islamic law applications, For increase clarification from the applying. | ||
