| المستخلص: | الاستحسان من الأدلة الشرعية المختلف فيها بين علماء أصول الفقه، وهو أحد طرق الاجتهاد التي يراعى فيها جانب التيسير والسعة في الشريعة الإسلامية بما يحقق مقاصد الشريعة وتتوائم مع تحقيق مصالح العباد، وتعين على سن القواعد والأنظمة في مجالات السياسة الشرعية، وفي هذا البحث ستتم دراسة الجوانب الآتية: أولاً: مفهوم الاستحسان من الجانب اللغوي والاصطلاحي. ثانياً: تمييز الاستحسان عن بعض المصطلحات، كالقياس، والمصالح المرسلة، والاستحباب، والبدعة. ثالثاً: الخلاف في حجية الاستحسان. رابعاً: مدى ارتباط دليل الاستحسان بالمقاصد الشرعية. خامساً: تطبيق الاستحسان في مجال السياسة الشرعية. Applause from the disputed Sharia evidence among the scholars of the origins of jurisprudence, which is one of the methods of ijtihad that takes into account the aspect of facilitation and amplitude in Islamic law in order to achieve the purposes of the Sharia and harmonize with the achievement of the interests of the slaves, and help to enact rules and regulations in the areas of Sharia policy, and in this research the following aspects will be studied: First: The concept of approbation from the linguistic and idiomatic side. Second: Distinguishing approbation from some terms, such as measurement, sent interests, desirability, and heresy. Third: The disagreement in the authenticity of approbation. Fourth: The extent to which the evidence of approbation is related to the legitimate purposes. Fifth: Application of approval in the field of legitimate politics. |
