| المستخلص: | تناول البحث مجموعة من المفاهيم والمصطلحات الفقهية، كالرخصة، والحرج، وتتبع الرخص، والضوابط الفقهية المتعلقة بهذه المفاهيم، والأدلة الشرعية على مشروعية الرخص وأحكامها وشروطها ومواضعها فيما يتعلق بالجمع بين الصلوات، وآراء الفقهاء فيما يصلح عذراً للجمع من أحوال الطقس، وكذلك ذم تتبع الرخص اتباعاً لهوى النفس، واللجوء إلى التلفيق بين الأقوال الفقهية المختلفة للترخص فيما لا رخصة فيه، ثم كان التعريف بالحرج الجالب لرخصة الجمع، والآثار الدالة على ذلك، وحصر الحالات التي يكون فيها الحرج معتبراً ويجوز بسببه الجمع. The research dealt with a set of concepts and Jurisprudential terms such as: The license, the restriction, license tracking, the jurisprudence controls related to these concepts, the forensic evidences for the legality of licenses and their regulations and conditions. The research went on to explain the matter of the suitable time for the license in combining prayers, more over, the jurists various opinions to demonstrate the acceptable licenses related to weather conditions when dealing with combining prayers. The study Also includes an obvious scold to: following licenses according to temper, using fabrication the various Jurisprudential opinions to Take What is not a license as a license. After all that, the research came up with the definition of the true reason Which gives the license for combining prayers with proofs on that. The study Also counted the cases in Which combining prayers regarded as legitimate. |
