| المستخلص: | يعد موضوع الدستور من أعقد وأخطر المشاكل التي واجهت بناء الدولة في اليمن واستقرارها منذ خمسينات القرن الماضي، لذا أجريت الدراسة بغية الوقوف على الأسباب لتجاوزها. وتتكون الدراسة من مبحثين، تناولت في المبحث الأول مسيرة التطور الدستوري في اليمن شمالا وجنوبا وأيضا اليمن الموحد بعد وحدته في 1990 م، وفي المبحث الثاني درست الأحوال التي صدرت في خلالها الدساتير، وختمت بخاتمة بينت فيها أهمية وجود قوة مؤثرة وقادرة على التعبير عن نفسها في ظل مناخ سياسي يحرر المواطنين من قيود القهر والخوف، وخلق مناخ سياسي يدمج المواطنين في عملية ديمقراطية تطلق روح المبادرة والإبداع، وتعمل على إشراك المواطنين على أساس ديمقراطية المشاركة وليس ديمقراطية الموافقة إن جاز التعبير. The subject of the constitution is one of the most complex and most serious problems facing the state building and its stability in Yemen since fifties of the last century, so the study was conducted in order to identify the reasons for overcoming thereof. The study consists of two sections, in the first section the process of constitutional development in Yemen in the north and south, as well as the unified Yemen after its unity in 1990 AD was discussed, while in the second section the situations in which the constitutions issued were studied. Finally, I concluded with an epilogue to the importance of influential power that should be capable to self-expression in the light of political climate that liberates citizens from the constraints of oppression and fear, and creates a political climate that consolidates citizens into a democratic process to releases the spirit of initiative and creativity, and works on involving the citizens on the grounds of a participatory democracy, not a consent democracy, so to speak. |
