| المستخلص: | تتناول هذه الدراسة الحماية الجزائية للبيئة في الأنظمة السعودية، حيث تستهدف الدراسة بيان موقف المملكة العربية السعودية من الجرائم البيئية، ومعرفة أوجه الحماية الجزائية المقررة للبيئة في النظام السعودي، وما مدى كفايتها لحماية البيئة، وتعرضت الدراسة المفهوم الجرائم البيئية وسماتها، وتناولت الدراسة الحماية الجزائية للبيئة في جميع عناصرها، فتعرضنا للحماية الجزائية للبيئة الهوائية، والحماية الجزائية للبيئة البحرية والمائية، والحماية الجزائية للبيئة البرية، واتبعت في هذه الدراسة المنهج الوصفي التحليلي والمنهج الاستقرائي لملائمته لموضوع البحث الذي يقتضي تحليل النصوص القانونية واستخلاص الأسس والقواعد المتعلقة بالحماية الجزائية وبيان مدى فاعليتها، ومن النتائج التي توصلنا إليها في هذه الدراسة: أن الأنظمة السعودية المتعلقة بالبيئة شاملة لكل جوانب البيئة الهوائية والمائية والبرية إلا أنه ما زال هناك الكثير من الجرائم التي ترتكب في حق البيئة كل يوم، ويرجع ذلك لقله الوعي البشري بخطورة الأمر لكون نتائجه غير ملموسة ولا تحدث على المدى القريب، وأوصينا بتكثيف البرامج والنشرات الإعلامية التي تتحدث عن موضوع البيئة وأهميته وتناول خطورة الموضوع بشكل كافي، وأوصينا أيضا بصياغة مادة دراسية للبيئة تقرر ضمن المناهج الدراسية في المدارس والجامعات، وضرورة الاهتمام بالأبحاث العلمية في هذا المجال لندرة الأبحاث التي تتحدث عن هذا الموضوع في المملكة العربية السعودية. This study deals with the penal protection of the environment in the Saudi systems. It aims to clarify the position of the Kingdom of Saudi Arabia regarding environmental crimes, and to know the aspects of penal protection for the environment in the Saudi system, and the extent of its sufficiency to protect the environment. The study was exposed to the concept and nature of environmental crimes and dealt with the penal protection of the environment in all of its elements, we were exposed to the penal protection of the aerobic environment, the penal protection of the marine and aquatic environment, and the penal protection of the terrestrial environment. In this study, the descriptive analytical approach and the inductive approach were followed for its suitability to the subject of the research, which requires the analysis of legal texts and the extraction of foundations and rules related to penal protection and its effectiveness. Among the results that we reached in this study: The Saudi regulations related to the environment include all aspects of the air, water and terrestrial environment, but there are still many crimes committed against the environment every day, and this is due to the lack of human awareness of the seriousness of the matter because its results are not tangible and do not occur in the short term, we recommended intensifying programs and media bulletins that talk about the issue of the environment and its importance and adequately address the seriousness of the issue, and we also recommended the formulation of a study subject for the environment to be decided within the curricula in schools and universities, and the need to pay attention to scientific research in this field due to the scarcity of research that talks about this topic in Saudi Arabia. |
