| 520 | |a يتناول هذا البحث موضوع مقاصد التبرعات، وهي العقود التي يتنازل فيها الإنسان عن بعض أمواله بمحض إرادته بلا عوض، وتظهر أهمية البحث من خلال ارتباطه بمقاصد التشريع، حيث يهدف إلى بيان المقاصد الخاصة بالتبرعات، وتوثيقها وضبطها؛ لكي يتسنى للمجتهدين مراعاة هذه المقاصد في تقرير المسائل الجزئية المعاصرة للتبرعات، وقد تم في هذا البحث اتباع المنهج الوصفي، مع الاستفادة من المنهجين الاستقرائي والاستنباطي. وكان من نتائج هذا البحث أن اختلاف عقود التبرعات عن عقود المعاوضات يترتب عليه أن مقاصد عقود المعاوضات تختلف عن مقاصد عقود التبرعات؛ فلا يصح قياس بعضها على بعض. كما توصل البحث إلى أن من مقاصد الشريعة الخاصة بعقود التبرعات: مقصد التعبد الله عز وجل والتقرب إليه، ومقصد إعانة الضعفاء من المسلمين، ومقصد إدامة تداول المال أطول مدة، ومقصد التكثير من التبرعات، ومقصد صدورها عن طيب نفس من المتبرع. |b This research deals with the subject of the Shariah purposes of donations. Namely, the contracts in which a person gives up some of his money of his own free will without compensation. The importance of the research appears through its relation with the purposes of legislation (the Shariah purposes), as it aims to clarify, document and control the purposes of donations. So that the mujtahids can take into account these objectives in determining the contemporary partial issues of donations. In this research, the descriptive approach has been followed, with the benefit of the two approaches: inductive and deductive. One of the results of this research is that the difference in the contracts of donations and the contracts of compensation implies that the purposes of the contracts of compensation differ from the intentions of the contracts of donations. It is not correct to measure each other. The research has also found that among the purposes of Sharia law regarding donation contracts: the purpose of devotion to God Almighty and drawing closer to Him, the purpose of helping the weak (poor) among Muslims, the purpose of maintaining the circulation of money for a longer period, the purpose of increasing the number of donations, and the purpose of giving them willingly from the donor. | ||
