| المستخلص: | فقد تناولت في هذا البحث المعنون له، (الأحكام الفقهية المتعلقة بالتنويم المغناطيسي في الأحوال الشخصية) والذي أهدف فيه لبيان الأحكام الفقهية في المنوم مغناطيسيا؛ في الأحوال الشخصية، قياسا على السكران والنائم، وعرضت مواقف العلماء، فمنهم من قال بأن طلاق السكران يقع، ولهم أدلتهم، ومنهم من قال بعدم وقوعه ولهم أدلتهم واستنباطاتهم، وقال به بعض العلماء المعاصرين، وهذا الذي أميل إليه؛ لكون السكران لا يعقل ما يقول، ولا يفرق بين الأمور. وقد أجمع العلماء بأن طلاق النائم لا يقع، وقياسا عليه فالمنوم تنويما مغناطيسيا طلاقه وظهاره ولعانه لا يقع. وليقيني أن كل ما أوردته إنما هو جهد المقل، الراجي لعون ربه، وزاد من معاناتي في هذا البحث قلة المصادر التي تناولت هذا الموضوع من الجوانب الفقهية. one of the most prominent characteristics of our Islamic law is the great concern for the interest of the individual and society... It came to clarify the provisions of islamic related to the individual in all his conditions, whether he is healthy or sick when he is consciously disabled, and when he no longer becomes aware of his illness, drunkenness, and so on. Our religious rules are valid for every place and time and they achieve justice. As a result, our scholars have dealt with hypnosis as a new science and people need to know the Islamic rules that associate with it. In this research we are exposing several things, including: 1-The rule of hypnosis is a new science in our religious law. 2-The rules related to the hypnotized person in the state of sleep. 3-The rules related to the hypnotized person in case of intoxication. The scholar's sayings about the occurrence of divorce and cursing of the hypnotized person would be shown with the evidence that proves it. And the scholar's sayings about the non-occurrence of divorce and cursing of the hypnotized person would be shown with the evidence that proves it Among the most prominent results that I reached, I tend to say that those who say that they fall due to the strength of their evidence and the relevance of their deductions and because this science is up-to-date and people need it, I recommend the students of knowledge. |
