| 520 | |a ترجع أهمية البحث ومشكلته إلى أنه بعد اتساع دائرة العنف في الآونة الأخيرة، وحدوث كثير من الجرائم الإرهابية (المحلية والدولية) التي تهدد سلم البشرية وأمنها، كان من الجدير بالاهتمام التعرض لظاهرة الإرهاب، وصورها، وأسبابها لتوضيح معالمها، وسبل مواجهتها، وعلى قمتها عرض الدور الذي تقوم به منظمة الأمم المتحدة بوجه خاص- للدفاع عن أهم مقاصدها، وهو حفظ السلم والأمن الدوليين. من هذا المنطلق يهدف البحث إلى عرض الجهود التي بذلتها منظمة الأمم المتحدة للتصدي لأعمال الإرهاب الدولي بطريقة تصاعدية، وذلك من خلال اثنين من أجهزتها الرئيسة وهما: (الجمعية العامة) والتي تعد البرلمان التشريعي للمنظمة، و(مجلس الأمن) وهو الحصن الأمين للسلم والأمن الدوليين. تتمثل الإجراءات المنهجية للبحث في المنهج التحليلي من خلال وصف ظاهرة الإرهاب وتحليلها، والمنهج التطبيقي وذلك من خلال عرض دور منظمة الأمم المتحدة في مواجهة الإرهاب، والجهود التي قامت بها من خلال أجهزتها المعنية بذلك. وتتضمن خطة البحث مبحثين، يعرض المبحث الأول محاولات القانون الدولي والفقه تعريف ماهية الإرهاب، أما المبحث الثاني فيتناول جهود منظمة الأمم المتحدة للتصدي للإرهاب ومواجهته والحد منه. وقد خلصت الدراسة إلى مجموعة من النتائج من أهمها: - جهود الأمم المتحدة في مواجهة الإرهاب الدولي: فهذه الجهود لم تتوقف منذ إنشائها، فقد اضطلعت الجمعية العامة ومجلس الأمن بدور حيوي في التصدي له، فقامت الجمعية العامة بإبرام عدد من الاتفاقيات والقرارات المتخذة بشأن ذلك الموضوع، بما في ذلك استراتيجية الأمم المتحدة العالمية لمكافحة الإرهاب، أما مجلس الأمن فقد بدأ تصديه لجميع الأعمال الإرهابية بداية بالإدانة، وصولا إلى اتخاذ التدابير الأساسية الملزمة للدول الأطراف للقضاء على الإرهاب الدولي. - إن جميع جهود الأمم المتحدة لمكافحة الإرهاب منذ اضطلاعها بالتصدي لتلك الظاهرة بدأت بالإدانة وصولا إلى اتخاذ تدابير أساسية وملزمة للدول الأطراف للقضاء على الإرهاب الدولي ومنعه وقمعه. |b The importance and problem of the research is due to the widening of the circle of violence recently, and the occurrence of many terrorist criminal acts (local and international) that threaten the peace and security of humanity, it was worthwhile to discuss the phenomenon of terrorism, its forms, and causes to illuminate its features and the means to confront it, and above all demonstrate the role undertaken by the United Nations in particular to defend its most important purpose, which is maintaining of international peace and security. From that standpoint The research aims to present the efforts made by the United Nations to confront acts of international terrorism in an ascending manner, through two of its main organs: (General Assembly), which is the legislative parliament of the organization, and (Security Council), which is the safe bulwark of international peace and security. The methodological procedures of the research are represented in the analytical method by describing and analyzing the phenomenon of terrorism, and the applied method by presenting the role of the United Nations in confronting terrorism, and the efforts exerted through its concerned bodies. The research plan includes two sections, the first section presents the attempts of international law and jurisprudence to define the nature of terrorism, while the second section deals with the efforts of the United Nations Organization to tackle, confront and limit terrorism. The study concluded a set of results, the most important of which are: The efforts of the United Nations in confronting international terrorism: these efforts have not stopped since its establishment. The General Assembly and the Security Council have played a vital role in confronting it. The General Assembly has concluded a number of agreements and resolutions adopted in this regard, including the UN Global Counter-Terrorism Strategy. As for the Security Council, it has started its response to all terrorist acts, starting with condemnation, ending with taking basic measures that are binding on state parties to eliminate international terrorism. -All the efforts of the United Nations to combat terrorism since its undertaking to address this phenomenon began with condemnation, leading to the adoption of basic and binding measures for the States Parties to eliminate, prevent and quell international terrorism. | ||
