| المستخلص: | يتطلب قانون السوق بالضرورة سن مجموعة من القواعد القانونية الهادفة إلى حماية المنافسة والمتنافسين على حد سواء، وذلك من خلال فرض جزاءات جنائية على مخالفي مقتضيات قانون حرية الأسعار والمنافسة، إلا أن تفعيل هذه الجزاءات من لدن القضاء المغربي يصطدم بمجموعة من الصعوبات، كصعوبة إعمال النيابة العامة لسلطة الملاءمة وصعوبة تحقق قاضي الموضوع من عناصر قيام الجريمة، نتيجة هيمنة الإدارة على إعداد ملف الدعوى، كما أن نص المشرع على جزاءات جنائية مهمة تزاوج بين العقوبات السالبة للحرية والغرامات... في القانون الأنف الذكر، ترتب عنه خلاف فقهي بين المهتمين بهذا القانون حول ملاءمة وفعالية هذه العقوبات في تسوية منازعات المنافسة، بين قائل بفعاليتها وملاءمتها وبين قائل بعدم ملاءمتها وفعاليتها. The market law needs making set of legal rules which aims at protecting both: rival and contenders by claiming criminal penalties against those who do not respect the requirements of law of prices and rival freedom; however, putting these criminal sanctions by the Moroccan judiciary faces set of difficulties like the difficulty of implementing the authority of appropriation by the public persecution and the difficulty the judge faces in making sure from the elements of the crime-conduct which is due to having the administration which is always in charge of preparing the file of the case. The law maker disputed various criminal sanctions that joins between both custodial sentences involving deprivation of liberty and fines … This law is a late motive behind a doctrinal controversy between those who are interested in this law, particularly on its suitability and effectiveness of these sanctions to settling competitiveness disputes between supporters and opponents. |
