| 520 | |a إن الأمن والاستقرار ضرورة من ضروريات الحياة، وقد انتبه الإنسان إلى تلك الضرورة منذ أن خلقه الله تعالى، واستمر شعوره بذلك رغم تطور العصر، ولابد من إنشاء عقوبة رادعة لمن يستهين بتحقيق الأمن والاستقرار للناس، ويفتعل الصراعات والمشاكل التي تهدد أمن المجتمع. ومما لا شك فيه أن تنظيم العقوبات على الجرائم يستحق العناية الكبرى، وخاصة في وقتنا الحاضر، فهدف الشريعة الإسلامية حفظ الكليات الخمسة، ولذا فقد حرمت الشريعة أي فعل يؤدي إلى المساس بتلك الكليات الخمس، وأكدت أن أي امتناع يضر بتلك الضروريات فهو حرام ويستحق فاعله العقاب. هذا وقد كان السبب في اختيار هذا الموضوع هو التعرف على العقوبة المترتبة على الامتناع عن تأدية الواجب وعلى ارتكاب الجريمة السلبية، مما يؤدي إلى صلاح أحوال الناس فيتوفر لديهم الأمن والسلام. وقد جاء البحث في مقدمة ومبحثين، وخاتمة وفهارس، تناولت المقدمة أهمية الموضوع وسبب اختياره، وتناول المبحث الأول التعريف بالجريمة وأركانها، وشروط تحققها، وأما المبحث الثاني فقد تناول التطبيقات الفقهية للجريمة السلبية، ومنها جريمة ترك العمل والامتناع عن تأدية الواجب، وترك الإنفاق على الحيوان وعدم الرفق به، وجريمة امتناع الأم عن إرضاع ولدها بقصد القتل، والامتناع عن إنقاذ السفينة من الغرق، وامتناع الشاهد عن الحضور لأداء الشهادة التي دعي إليه، وامتناع الزوجة مرافقة الزوج في السفر، وامتناع الإعلان عن وفاة الميت والتبليغ عنه. وتنتهي الدراسة بخاتمة تناولت فيها أهم النتائج التي أسفر عنها هذا البحث، ثم المصادر والمراجع. |b Security and stability is one of the necessities of life, and man has paid attention to this necessity since God Almighty created him, and he continues to feel this despite the development of the era, and a deterrent punishment must be established for those who underestimate the achievement of security and stability for people, and create conflicts and problems that threaten the security of society. There is no doubt that regulating penalties for crimes deserves great care, especially in our present time, as the goal of Islamic law is to preserve the five colleges, and therefore the law has forbidden any action that leads to prejudice to those five colleges, and confirmed that any omission that harms those necessities is forbidden and its perpetrator deserves punishment. The reason for choosing this topic was to identify the punishment resulting from refraining from performing duty and committing a negative crime, which leads to the improvement of people's conditions and provides them with security and peace. The research came in an introduction, two sections, a conclusion, and indexes. The introduction dealt with the importance of the subject and the reason for its selection. The first section dealt with the definition of crime, its elements, and the conditions for its realization. As for the second section, it dealt with the jurisprudential applications of negative crime, including the crime of leaving work, refraining from performing duty, and leaving spending on animals. Not being kind to him, the crime of the mother’s refusal to breastfeed her son with intent to kill, the refusal to save the ship from sinking, the witness’ refusal to attend to perform the testimony to which he was called, the wife’s refusal to accompany the husband on travel, and the refusal to announce and report the death of the deceased. The study ends with a conclusion in which it deals with the most important results of this research, then the sources and references. | ||
