| المستخلص: | لقد نظم المشرع الجزائري مهنة المهندس المعماري من خلال المرسوم التشريعي 94/07 المؤرخ في 15/05/1994 المتضمن شروط الإنتاج المعماري وممارسة مهنة المهندس المعماري، وجعله من خلال هذا النص، صاحب مهنة منفصلة عن المقاول، فعمله يشكل فنا مستقلا، فهو لا يضارب على السلع كالمقاول، لذا فهو مبدع وفنان، وبالمقابل فإن الأمر 03/05 المؤرخ في 19/07/2003 المتضمن حماية حقوق المؤلف والحقوق المجاورة لها، منح صاحب كل إبداع أصلي مصنف أدبي أو فني، ويمنح الحماية مهما كان نوع المصنف ونمط التعبير، ونتاج المهندس المعماري للتصاميم الهندسية والتي نالت درجة من الحماية وبالتالي نال المهندس المعماري مجموعة من الحقوق، قد تكون معنوية أو مالية نتيجة مصنفه الهندسي. The Algerian legislator has regulated the profession of the architect through, Decree 94/07 of/18/05/1994 which includes the conditions for architectural production and the practice of the profession of the architect, and made him, through this regulation, a profession separate from the contractor, as his work constitutes an independent art, as he does not speculate on goods as the contractor, so he is a creator and artist, and on the other hand, order 03/05 of 19/07/2003, which includes the protection of copyright and related rights, as well as granting the owner of every original creation a literary or artistic work, and grants protection regardless of the type of work and the pattern of change, and the architect’s product designs Engineering, which received a degree of protection and consequently the architect obtained a set of rights, may be moral or financial as a result of his engineering work. |
