| المستخلص: | تأتي هذه الدراسة لتناول الشركات الفقهية ومدى انسجام أحكامها مع ما عرفته القوانين الوضعية، وهو ما دفعني لتناول أحكام الشركات الفقهية وأنواعها قبل تناول بعض أحكامها، والمقام تطلب تناول أحكام شركة العنان لأنها النموذج الأبرز والذي بقي صامدا وأخذت الشركات المدنية والتجارية أغلب أحكامها ، كما حاولت تناول أحكام المضاربة نظرا لتطبيقاتها في الشركات المالية الحديثة خصوصا المصارف والصناديق الاستثمارية، ونظرا لقربها في جوانب استثمار أموال المودعين والمكتتبين من نظام المضاربة أو القراض المعروف لدى فقهائنا المسلمين، وفي كل ذلك أردت أن أوضح التقارب بين أحكام الشركات الفقهية وردها ما أمكن إلى أهم مصدر للقانون وهو الفقه الإسلامي. This study comes to address jurisprudential companies and the extent to which their rulings are consistent with what is known by statutory laws, which is what prompted me to discuss the rulings of jurisprudential companies and their types before dealing with some of their rulings. The place requires dealing with the rulings of Al-Anan Company because it is the most prominent model that has remained steadfast, and civil and commercial companies took most of its rulings. I also tried to address the provisions of speculation in view of their applications in modern financial companies, especially banks and investment funds, and in view of their closeness in aspects of investing the funds of depositors and subscribers to the system of speculation or credit known to our Muslim jurists. In all of this, I wanted to clarify the convergence between the provisions of corporate jurisprudence and to refer them as much as possible to the most important ones. A source of law, which is Islamic jurisprudence. |
