| المستخلص: | إن هذه الورقة البحثية تأتي بعنوان: (العوامل المؤثرة في الإجرام -دراسة مقارنة بين القانون الوضعي والفقه الإسلامي) لأنها تهدف إلى فهم الظاهرة الإجرامية والتفسير الموضوعي لعوامل السلوك الإجرامي، وكذلك للوقوف على الدوافع الحقيقية التي تحرك فهم جوانب القوة والضعف في الشخصية السوية أو المنحرفة، ونستهدف في هذا البحث إيجاد مدخل للعوامل المؤثرة في الإجرام باعتباره علما حديثا للسيطرة على ظاهرة قوى الإجرام والشر في هذا الكون من خلال نعمة العقل التي منحنا إليها الخالق عز وجل، وذلك كله من أجل إيجاد قانون ينظم الحياة. كما أن أهمية دراسته تتمثل في أن علم الإجرام من المفاهيم المعقدة باعتباره أحد فروع العلوم الجنائية المساعدة كما أنه يتميز بدورة الواضح في دينامية القانون وفق دراسة شخصية المجرم والجريمة نفسها وبناء على ذلك فقد أجمعت مدارس علم الإجرام على أهمية دراسة هذا العلم، ومن هذا المنطلق وجدنا أنه من الأهمية بمكان دراسة العوامل المؤثرة في الإجرام وعلاقتها بالعلوم الجنائية الأخرى والشرع الإسلامي الحنيف الذي تتبعه، آخذين في اعتبارنا وجود نظريات وضعية مختلفة مثل التي تناولت التكوينات البيلوجية وعامل تأثير المجتمع والأسرة كعوامل مؤثرة في سلوك الفرد وكذلك المتغيرات التي نتوقع أن تسهم في وجود علم إجرام مساعد للقانون الجزائي، وكذلك لخطورة الجريمة على المجتمع مع الندرة والحرج في تناول نظريات وأبحاث هذا العلم بمجتمعاتنا الشرقية، فقد أصبحت المؤلفات والمراجع نادرة وتكاد تكون معدومة لدينا مما جعلنا نتناول هذا البحث بالمنهج العلمي الذي يقوم على الوصف وتتبع النصوص والاستنباط منها، وبهذا يكون من ضمن البحوث الوصفية بمحتواه قسمين، الأول عن (التمهيد والتعريف بعلم الإجرام) والقسم الثاني عن: (العوامل المؤثرة في الإجرام بالتطبيق على مفهوم الدين الإسلامي). وفي نهاية المطاف تأتى خاتمة البحث والنتائج التي تتمثل في أن علم الإجرام يأتي على قمة العلوم الجنائية الحديثة والأكثر تأثيرا في مجريات الأمور داخل المجتمع من النواحي الثقافية الاقتصادية والاجتماعية والأمنية بل والسياسية، كما أن علم الإجرام بحسب الأصل علم قانوني متقدم وراسخ لاهتمامه بالبعد الإنساني وأنه متميز من حيث نظرياته ومبادئه وأسسه وأصوله التي يقوم عليها وهي كلها تسعى لدراسة ظاهرة العوامل الإجرامية ومعالجتها ومكافحتها. ولقد توصلنا أيضا لنتائج أن لفكر الدين الإسلامي من المبادئ والنظريات ما لا يقل عن الفقه الوضعي الحديث في الصناعة وفي إحكام الصنعة من أحداث المبادئ والنظريات الفقهية التي نتلقاها اليوم، ثم أخيرا تأتي التوصيات التي توصلنا إليها ومرفق معها الفهرست وقائمة باسماء المراجع والمؤلفات التي استرشدنا بها، آملين ومتمنين من المولى عز وجل أن نكون قد اجتهدنا وأصبنا عين الحقيقة نفعا لمجتمعنا الإسلامي والعربي والأفريقي ثم العالم أجمع. This research paper is entitled: (Factors affecting crime-a comparative study between jurisprudence law and Islamic jurisprudence) because it aims to understand the criminal phenomenon and objective interpretation of the factors of criminal behavior, as well as to determine the real motives that drive the understanding of the strengths and weaknesses of a normal or deviant personality. In this research, we aim to find an introduction to the factors affecting crime as a modern science to control the phenomenon of criminal and evil forces in this universe through the gift of reason that the Almighty Creator has given us, all in order to find a law that regulates life. The importance of his study is that criminology is a complex concept, as it is one of the branches of auxiliary criminal sciences, and it is characterized by a clear role in the dynamics of the law according to the study of the criminal’s personality. And the crime itself. Accordingly, the schools of criminology have unanimously agreed on the importance of studying this science. From this standpoint, we found it important to study the factors affecting crime and their relationship to other criminal sciences and the true Islamic law that follows them, taking into account the existence of various positivist theories, such as those that dealt with formations. Biological factors and the influence of society and family as factors influencing the behavior of the individual, as well as the variables that we expect will contribute to the existence of a criminology that is auxiliary to the criminal law. And also due to the seriousness of crime to society, with the scarcity and embarrassment of dealing with theories and research of this science in our Eastern societies, literature and references have become rare and almost non-existent with us, which made us approach this research with the scientific method that is based on description, tracking texts, and deducing from them, and thus it is within the descriptive research with its content in two parts. The first section is about (introduction and introduction to criminology) and the second section is about: (factors affecting crime in application to the concept of the Islamic religion).In the end, the conclusion of the research and its results is that criminology is at the top of the modern criminal sciences and has the most influence on the course of affairs within society from the cultural, economic, social, security, and even political aspects criminology, by origin, is an advanced and well-established legal science due to its interest in the human dimension, and it is distinguished in terms of its theories, principles, foundations, and principles on which it is based, all of which seek to study the phenomenon of criminal factors, treat them, and combat them. We have also reached the conclusions that Islamic religious thought has no less principles and theories in industry. And in the precise craftsmanship of the latest principles and theories of jurisprudence that we receive today from modern positive jurisprudence, Finally, conclusion comes and recommendations which we conclude followed by index, list of reference, and books we used, wishing that our Allah will benefit and serve our Arabic, African, Islamic society and for all mankind. |
