| المستخلص: | ارتقى الدستور المغربي بمؤسسة الوسيط إلى مستوى الهيئات الموكول لها ترسيخ قيم الحكامة الجيدة، وحدد لها وظيفتها الأساسية كمؤسسة وطنية مستقلة ومتخصصة، باعتماد مناهج عمل جديدة، وسلطات واسعة، وهيكلة متطورة للرفع من فعاليتها ونجاعتها، إلا أن الإشكال المرتبط بها نظرا للطابع الشخصي للمؤسسة، هو طبيعة الضمانات التي يتمتع بها الوسيط كمورد بشري، وهي ضمانات يؤطرها القانون المرجعي للمؤسسة كأسلوب التعين والقابلية للتجديد...)، وضمانات واقعية يفرضها واقع اشتغال المؤسسة كأحوال التنافي والحصانة والصفات الأخلاقية والعلمية......). هذه الضمانات ينبغي ترسيخها والتنصيص عليها، لما لها من ارتباط بحماية مظاهر الاستقرار والاستقلال لدى الوسيط، ولها تأثير على منتوج المؤسسة ككل، كما تفسر الخصوصية التي تتفرد بها (فالوسيط لا ينطق بالقانون وإنما بما هو عادل ومنصف)، وتمنحها الاستمرارية والتوازن والفعالية في أفق تجويد العلاقة بين الإدارة والمواطن. The Moroccan constitution rises the mediation institution to the level of the bodies responsible for inchoring the good refereeing values. It also determines its major duty as a specialized independent national institution, through out the use of new approaches, large authorities moreover advanced structurization in order to increase its effectiveness. However, the related issue to subjective characteristic of the institution is the nature of guarantees that the mediator, endowed as a human resource. They are guarantees framed by the institution reference law, (as a method of creation and renewable viability). Furthermore realistic guarantees imposed by the factual institution’s work (as incompatibility states, immunity, moral and scientific characteristics), which must be consolidated and stipulated, These guarantees are not only related to the safeguarding of independence and stability aspects but also have an impact on the institution’s product. As well as explaining its unique aspect (The mediator doesn’t act upon the law, yet remains fair and just) which helps it afford the continuity, the balance and the effectiveness in hopes of strengthening the relationship between the institution and the citizen. |
