| المستخلص: | تناقش هذه الدراسة القواعد الفقهية الضابطة لعقود الزواج المستحدثة، وبيان أحكام هذه العقود، وذلك في تمهيد ومبحثين مسبوقين بمقدمة، ومختتمين بخاتمة. أما عن التمهيد، فقد اشتمل على أربعة مطالب تضمنت معنى القواعد الفقهية والألفاظ ذات الصلة، وأهمية القواعد الفقهية وأقسامها، ومصادر القواعد الفقهية، وحجيتها. أما عن المبحث الأول فقد جاء بعنوان: القواعد الفقهية الضابطة لتطور آليات إجراء عقد الزواج"، وناقش إجراء عقد الزواج عبر وسائل الاتصالات الحديثة، كإجراء عقد الزواج عن طريق المكالمات الصوتية، والمراسلة الكتابية، وتقنيات الفيديو والكاميرا. أما عن المبحث الثاني، فقد جاء بعنوان: "القواعد الفقهية الضابطة للشروط الجعلية في عقد الزواج"، وناقش الشروط الجعلية التي تحتويها بعض عقود الزواج، كزواج المسيار، والزواج بنية الطلاق، والزواج المؤقت بحصول الإنجاب. الخاتمة وتضمنت أهم نتائج البحث. This study discusses the jurisprudential rules governing the updated marriage contracts, and the statement of the provisions of these contracts, within a peeface and two topics preceded by an introduction, and concluded with a conclusion. As for the preface, it includes four demands that contain the meaning of jurisprudential rules and related terms, the importance of jurisprudential rules and their divisions, the resources of jurisprudential rules, and their authoritativeness. As for the first topic, it came under the title: "The jurisprudential rules governing the development of the procedures of conducting the marriage contract." It discussed the conduct of the marriage contract through modern means of communication, such as conducting the marriage contract through voice calls, written correspondence, video and camera techniques. As for the second topic, it came under the title: ''The jurisprudential rules governing the presumptive conditions in the marriage contract. ''It discussed the presumptive conditions contained in some marriage contracts, such as Misyar marriage, marriage with the intention of divorce, and temporary marriage with the occurrence of childbearing. Conclusion: It includes the most important research findings. |
