| المستخلص: | تظهر مع مر الزمن أمراض لم يعرفها السابقون، وهي ما يسمى بالنازلة الطبية التي يحتاج المعاصرون لها إلى معرفة حكم الشارع فيها، لذا كان لزاما على من تعين عليه بيان أحكام الله تعالى أن يعمل جهده، ويفرغ وسعه للكشف عنها. الأمر الذي يتطلب منه القدرة على التأصيل، والمكنة من الضبط والتقعيد، ملتزما النص الشرعي، وقواعد الشريعة العامة ومقاصدها. متقيدا بتصوير ذوي الاختصاص، ليحقق الفقيه الفهم السليم، فيسلم له الحكم الصحيح، ملتزما التأصيل وفق أصول التشريع الأصيلة والتبعية دون الإلزام بأصول مذهب بعينه، مراعيا القواعد العامة في الشريعة ومقاصدها، مع النظر في العواقب والمآلات، مع ضرورة طالب جماعية الفتوى. With the passage of time, diseases appear that the predecessors were unaware of, we identify such an event as medical modern issues, where contemporaries need to know it’s shariah rules. Therefore, it is obligatory to those who are assigned to research it to do all they can and put all effort into understanding and teaching the rulings of shariah laws in that regard. Which requires him to be able to root, diligence, and to be able to control and complicate, committed to the legal text, and the rules and purposes of the general Shariah law. Adhering to the depiction of professionals, so that the jurist achieves a sound understanding, so that the correct judgment is handed over to him, committed to rooting in accordance with the principles of legislation; Authentic and dependent without obligating the principles of a particular doctrine, considering the general rules in Sharia and its purposes, while considering the consequences and outcomes, with the need of the collectiveness of the Fatwa. |
