| 520 | |a يتناول هذا البحث مفهوم النشوز في الفكر الإسلامي المعاصر، ويعرض للاتجاهات والآراء فيه، وفق منهج تحليلي نقدي، كما يبين المنطلقات الفكرية والمنهجية لكل اتجاه، ومدى قيمة وأصالة هذه الرؤى والأفكار؛ فيعرض للاتجاه القرآني المحض، والاتجاه الذي يوظف بعض الأحاديث والآثار بجنب القرآن الكريم، ثم بعض الاتجاهات الأخرى. وتظهر أهمية البحث في كونه يلقي الضوء على جزئية لها مدخلية مباشرة لفهم موضوع (الضرب) الوارد في آية نشوز المرأة بالقرآن الكريم. ومن أهم النتائج التي توصلت إليها: أن باعث بحث النشوز في الفكر الإسلامي المعاصر على العموم هو بحث قضايا المرأة وحقوقها، وأن القدر المتيقن الذي لا خلاف عليه في تفسير نشوز المرأة خاصة هو: إرادة المرأة غير زوجها، وميلها ونفرتها عنه، وشكاسة أخلاقها مع إتيان الفاحشة بمعناها العام، وهو عموما معنى نشوز الزوج، وأن هناك اختلافا كبيرا في مدلول النشوز في الفكر الإسلامي المعاصر، تبعا لاختلاف المنطلقات والأهداف، فمن معانيه عند المعاصرين: تقوقع المرأة على ذاتها، خيانتها لزوجها، خروجها عن منظومة العفة والعدل والصلاح الفاحشة المبينة ميل الزوج عن زوجته. |b This research deals with the concept of disobedience in contemporary Islamic thought, and presents trends and opinions in it, according to an analytical and critical approach. It also shows the intellectual and methodological principles of each direction, as it presents the purely Qur'anic direction, and the trend that employs some Hadiths beside the Holy Qur'an. Then some other directions. The importance of the research appears in that it sheds light on a part that is directly related to understanding the subject of (beating) contained in the verse of the woman's Nushūz in the Holy Qur'an. The most important results that I reached: - The motive for- discussing disobedience in contemporary Islamic thought in general is to discuss women's issues and rights. - It appeared to us that the concept of a woman's disobedience in particular is: the desire of a woman other than her husband, her inclination and repulsion from him, and her rudeness in her morals, with immorality in its general sense, It is generally consistent with the meaning of the husband's rebellion as well. - There is a great difference in the meaning of disobedience in contemporary Islamic thought, depending on the different premises and goals, Among its meanings are: A woman's isolation from her husband, her betrayal of her husband, her departure from the system of chastity, justice and righteousness, the obvious immorality A husband's deviation from his wife. | ||
