| المستخلص: | لقد منح مجلس المنافسة مجموعة من الاختصاصات وزود بمختلف الوسائل والآليات للقيام بدوره فيما يتعلق بمراقبة عمليات التركيز الاقتصادي، وتجنبا لتجاوز السلطة والسقوط في الشطط عند ممارسة مجلس المنافسة لمهامه، فإن المشرع قد أقر على أن الضامن لحقوق المؤسسات في مواجهة مجلس المنافسة هو القضاء باعتباره الساهر على مراقبة تطبيق القانون، ففي الجزائر تنعقد الولاية في الفصل في منازعات التركيز الاقتصادي لمجلس الدولة، ويتم تحديد الاختصاص لصالح هذا الأخير من خلال النصوص المنظمة لهياكل القضاء الإداري وقانون الإجراءات المدنية والإدارية وكذلك النص المتعلق بالمنافسة. Many competences are given to the concurrence council, and it disposes of several means and mechanisms to accomplish his role concerning the control of economical concentration operations, and to avoid the abuse of power and to fall inroad when the concurrence council practices his functions, the legislator has admitted that the guarantor of Institutions the rights in the confrontation of the concurrence council is the jurisdiction as a responsible of the control on the application of law. In Algeria, the province is gathered to stand out in economical concentration disputes of the state council, and the competence is fixed for this jurisdiction through the texts organizing the administrative jurisdiction structures and the administrative and civil code and also the text concerning the concurrence. |
