| المستخلص: | تعمل الدول النامية على تشجيع الاستثمار في مجال نقل التكنولوجيا من أجل الحصول على المعرفة الفنية التي تعتبر عاملا أساسيا لتطوير وتنمية اقتصاديات هذه البلدان. إذ لم يعد يقتصر الاستثمار على مجرد جذب رؤوس الأموال بل أصبح يشمل أيضا تمكين الدول طالبة الاستثمار من الحصول على المعرفة التكنولوجية التي تؤهلها للتصنيع والإنتاج بشكل مستقل. وقد تزايد دور التحكيم بوصفه وسيلة أساسية لحسم منازعات عقد الاستثمار التكنولوجي؛ فهو يتماشى مع طبيعة هذا العقد لاعتبارات عدة أهمها: المحافظة على السرية المتطلبة في هذا العقد كما أنه يحقق سرعة الفصل في النزاع، بالإضافة إلى الحرية التي يتمتع بها طرفي النزاع في تحديد القانون الواجب التطبيق على موضوع التحكيم وإجراءاته؛ وهذا يعد بحق ضمانة أساسية لتشجيع الاستثمار التكنولوجي. Developing countries are working to encourage investment in technology transfer in order to obtain technical knowledge, which is a key factor for development and development of the economies of these countries. The investment is no longer limited to just attracting capital, but it has also become understood to allow States' investment asking for technological knowledge that qualifies them for manufacturing and production independently. The role of arbitration has increased as an essential means to resolve disputes in the technology investment contract, it is inconsistent with the nature of this contract to several considerations, including: maintain the confidentiality required in this contract. It also carries out an early settlement of the dispute, in addition to the freedom enjoyed by the parties to the dispute, by determining the applicable law on the subject of arbitration and procedures, and this is a fundamental guarantee to encourage technological investment. |
