| 520 | |a الأهداف: هدفت هذه الدراسة إلى بيان قدرة الدول على تطبيق القيود والتدابير الصارمة على حقوق الإنسان فيما يتعلق بحالات الطوارئ العامة كجائحة COVID-19؛ إذ يقع على عاتق الدول واجب والتزام بالعمل في أسرع وقت ممكن وبأنسب التدابير؛ من أجل حماية حياة الناس وصحتهم. المنهج: اتبع البحث أسلوب التحليل المقارن بين تقييد الحقوق الذي قامت به الكويت من أجل الحد من انتشار الجائحة، وإن كان يهدف لتحقيق الصالح العام وهو حماية حياة الأفراد، وبين قواعد القانون الدولي العام وقواعد حقوق الإنسان. النتائج: خلصت الدراسة إلى، أن القانون الدولي لم يمنع الدول من اللجوء إلى تقييد الحريات الأساسية لحقوق الإنسان إذا ما وقعت حالة طوارئ عامة تجتاح البلاد، وبما أن جائحة COVID-19 صنفت على أنها حالة طوارئ في العالم أجمع، فالوضع أن هذه الظروف الاستثنائية، وإن كانت تعتبر حالة ضرورة، فإننا لا نرى تناسبا في التطبيق. الخاتمة: اتخذت الكويت إجراءات غير مسبوقة لمحاولة الحد من انتشار هذه الجائحة وضمان سلامة الأفراد وصحتهم في محاولة للحفاظ على النظام الصحي من بلوغ مرحلة الخطورة أو الانهيار؛ ومن ثم لجأت الكويت إلى تقييد حقوق أساسية للناس مع محاولة مراعاة عدم المساس بالحقوق الأساسية الكبرى؛ كحق الحياة، الذي كانت حمايته الهدف من تقييد الحقوق الأخرى. |b Objectives: This study aimed to demonstrate the ability of states to apply strict restrictions on human rights in relation to public emergencies such as the COVID-19 pandemic, where states have a duty and obligation to act as quickly as possible and with the most appropriate measures in order to protect people's lives and health. Method: The research followed the method of comparative analysis between the restriction of rights carried out by Kuwait, and the rules of public international law and the rules of human rights. Results: The foregoing that international law did not pre- vent states from resorting to restricting basic human rights freedoms in the event of a public emergency sweeping the country. And since the COVID-19 pandemic had been considered an emergency worldwide, the situation is that these exceptional circumstances through being considered a case of necessity, we do not see however proportionality in the implementation. Conclusion: Kuwait has taken unprecedented measures to try to limit the spread of this pandemic and maintain safety and health of individuals in an attempt to preserve the health system from reaching the stage of danger or collapse. Therefore, Kuwait resorted to restricting basic rights of people, while trying to take into account not violating the major basic rights, like the right of life, preserving which was the ultimate target eventually. | ||
