| 520 | |a يعتبر كتاب «صحيح مسلم» من المصادر المهمة في المكتبة الإسلامية، خدمه العلماء شرحا وتعليقا، ومن المعاصرين الذين تشرفوا بخدمة هذا الكتاب بالشرح الشيخ محمد تقي العثماني (مواليد ١٣٦٢هـ/ ١٩٤٣م)، الذي أثرى المكتبة الإسلامية بكتب مفيدة في التفسير والحديث والفقه. نشرت للشيخ "تكملة فتح الملهم في شرح صحيح مسلم" في ستة مجلدات. تدرس هذه الورقة منهج الشيخ في شرحه لأحاديث كتاب البيوع من صحيح مسلم فيما يتعلق بالنوازل المالية فقط. والأسلوب المتبع في الورقة هو البحث النوعي القائم على عرض ما ذكر في "تكملة فتح الملهم في شرح صحيح مسلم" في النوازل المالية، وإعداد دراسة خاصة بمنهج الشيخ فيها من خلال استقراء النوازل المالية التي تناولها الشيخ، ثم وصف طريقته في استعراضها. استنتجت الورقة أن الشيخ حرص على ربط أحاديث "صحيح مسلم" بالنوازل الفقهية مع تقديم بدائل شرعية أو مخارج شرعية أحيانا، ومن تلك المسائل: البوفيه في الفنادق، واستئجار السيارات، والأوراق التجارية، وأوراق العملة، والعملة المسكوكة الرائجة. واعتمد الشيخ في تخريج تلك المسائل على نفي الفارق أو إثبات الجامع أحيانا، مع تشخيص الواقع المعاصر، من خلال تقديمه للقراء الباحثين نماذج من فقه الواقع. كما حرر الشيخ بعض المسائل المعقدة مع تحليل دقيق لأقوال الفقهاء فيها، مثل: مسألة ما يتعامل الناس اليوم في بيع الثمار. |b The book “Sahih Muslim” is considered one of the important sources in the Islamic library, in which scholars have expanded in their explanations and commentaries. Amongst the contemporary scholars who had the honor to explain this book was Sheikh Muhammad Taqi Al-Othmani (born in 1362 AH/1943 AD). He is considered one of the prominent figures in the scientific community in the Islamic world and has enriched the Islamic library with useful books in interpretation, hadith and jurisprudence. It was published by the sheikh, “Takmalah Fath Al-Mulhim Fi SharhSahih Muslim” authored by the Sheikh in six volumes. This research paper deals with the method of Sheikh Muhammad Taqi Al-Othmani in explaining the sales section of Sahih Muslim related only to the Unprecedented Financial Issues. The technique in this paper is the qualitative research based on presenting what is mentioned in “Takmalah Fath Al-Mulhim” book in the Unprecedented Financial Issues, and prepare a special study of the Sheikh’s method by extrapolating Unprecedented Financial Issues that the Sheikh dealt with, then describe his way in demonstrating them. It is concluded in this paper that the Sheikh was keen to link the Hadiths of “Sahih Muslim” with the Unprecedented Financial Issues and provide legitimate alternatives or sometimes legitimate exits. As examples of these issues: Hotel buffets, car rentals, commercial papers, banknotes and tradable coins. In extraction of these issues, the Sheikh relied on denying the difference, or sometime proving the uniting, with diagnosing the contemporary reality by presenting to the reader researchers’ models of the jusritic of reality. The Sheikh edited some complex issues with a thorough analysis of the sayings of the jurists, for example: what people deal with today in the issue of selling fruits. | ||
