| المستخلص: | يهدف البحث إلى إثبات نسبة كتاب يتيمة الدهر في فتاوى أهل العصر إلى عبد الرحيم الترجماني، لا ما تداولته كتب الفقه الحنفي وكتب التراجم من نسبته إلى محمد بن محمود الترجماني، كما يهدف إلى تقديم ترجمة مناسبة للإمام عبد الرحيم الترجماني الخوارزمي الذي لم يأخذ حقه من التعريف به، إذ إن المصادر تذكره بكلمات لا تتجاوز السطر. ولما كان هذا الكتاب من كتب الفتاوى المشهورة عند السادة الحنفية؛ كان لا بد من التعريف به وبيان قيمته العلمية التي جعلت كتب المذهب تستدل به. ومنهج البحث قائم على استقراء ما جاء في مخطوطة الكتاب وتحليل عباراته وتوثيق مضامينها، وتتبع ما كتب في المصادر المختلفة، والمقارنة بين ما ورد فيها وما ورد في الكتاب، ثم التحليل والربط والاستنباط لإثبات نسبة الكتاب لعبد الرحيم الترجماني، وللتوصل إلى سيرة مناسبة له متطرقة إلى الحديث عمن كان لهم به علاقة من العلماء، ومن ثم التعريف بيتيمة الترجماني. وأهم الخلاصات التي خلص إليها البحث أن مؤلف كتاب يتيمة الدهر في فتاوى أهل العصر هو عبد الرحيم الترجماني، وأن نسبته إلى محمد بن محمود الترجماني هفوة في كتب الفقه والتراجم، وأن عبد الرحيم الترجماني الفقيه الحنفي كان معتزليا، وكان من نجباء فقهاء خوارزم تلقى العلم على أيدي كبار مشايخها، وكان له دور كبير في حفظ فتاواهم التي استدلت بها كتب الحنفية وحفظ تراجمهم التي لا تكاد تذكر في غير يتيمته، وأن ما يميز كتابه جمعه في المسألة الواحدة آراء علماء عصره ومن قبلهم، وذكره لبعض علماء خوارزم الذين لم يذكروا في غير اليتيمة من الكتب. The study aims the attribution of "Yatimat ad-dahr fi fataawa ahl al- 'asr" (A unique collection of fatwas of scholars of our time) to 'Abd ar- Rahim Ibn 'Umar at-Tarjumani, not to Mohammed Ibn Mahmoud at- Tarjumani, as the Hanafi books and biography books say. As well as the study aims reaching the appropriate biography for imam 'Abd ar-Rahim Ibn 'Umar at Tarjumani, whose life is not given due attention in the sources. Considering this book to be very famous among the Hanafi scholars, it is necessary to explore it and to explain its scientific importance that made the books of the doctrine inferred by it. The research method is based on extrapolating what came in the manuscript of the book, analyzing its phrases, documenting its contents, following various sources, comparing them with the book. The analysis, linking and deduction was also made to prove the book's attribution to 'Abd ar-Rahim Ibn 'Umar at-Tarjumani and to write the biography, which also contains the information about the scholars, who had any relationships with him, there is also an acquaintance with "Yatimat" at-Tarjumani. The most important conclusions that the research concluded is that the author of the book "Yatimat ad-dahr fi fataawa ahl al 'asr" is 'Abd ar-Rahim at- Tarjumani, and that his attribution to Muhammad ibn Mahmoud al- Tarjmani is a lapse in the books of jurisprudence and translations, and that 'Abd ar-Rahim at-Tarjumani, the Hanafi jurist, was a Mu'tazilite, and he was one of the noble jurists of Khwarazm who received knowledge on The hands of its senior sheikhs, and he had a great role in preserving their fatwas that were inferred by the Hanafi books, and that what distinguishes his book is his collection on one issue of the opinions of the scholars of his time and before them, and mentioning some of the scholars of Khwarazm who were not mentioned in other books. |
