| المستخلص: | تستهدف هذه الدراسة جمع القواعد والضوابط الفقهية المتعلقة بما يحل ويحرم من الحيوان واستنباطها، من كتاب حياة الحيوان الكبرى للإمام الدميري، ودراستها دراسة نظرية، وتقوم هذه الدراسة على المنهج الاستقرائي والاستدلالي والتحليلي من خلال تبيين معنى كل قاعدة وضابط، والأدلة الشرعية والتعليلات الفقهية المبينة لحجيتها، مع بيان الفروع المندرجة تحت هذه القواعد والضوابط. وقد تطلب البحث تقسيم هذه الدراسة على مقدمة وتمهيد ومبحثين. خصص المبحث الأول: لبيان القواعد الفقهية، والمبحث الثاني للضوابط الفقهية المتعلقة بما يحل ويحرم من الحيوان، جمعا ودارسة. وتمخض عن هذه الدراسة جملة من النتائج منها: اشتمال كتاب الحيوان للإمام الدميري على جملة من القواعد الفقهية المتعلقة بما يحل ويحرم أكله من الحيوان منها: قاعدة: كل ما ورد النص بإحلاله فهو حلال، وقاعدة: كل ما نص على تحريمه فهو حرام، وقاعدة: الأصل في الأشياء الإباحة حتى يدل الدليل على التحريم، وقاعدة: إذا اجتمع الحلال والحرام غلب الحرام، وقاعدة الاستطابة والاستخباث. وجملة من الضوابط الفقهية، منها: كل ذي ناب من السباع فأكله حرام، وكل ذي مخلب من الطير فأكله حرام، وكل ما أمر بقتله من الحيوانات فحرام أكله، وما نهي عن قتله فحرام أكله، وما تولد بين مأكول وغيره فأكله حرام، وتحرم الحشرات بأسرها إلا ما استثني، وكل ما يقتات من النجاسات والخبائث فأكله حرام، وكل نقاش حرام أكله. This study aims to derive and collect jurisprudential rules and regulations related to what is permitted and prohibited from animals, from the book "The Great Life of Animals" by Imam al-Damiri, and to study them theoretically. It will be done by clarifying the meaning of each rule and regulation, and the legal evidence and jurisprudential explanations that demonstrate itsjustification, with an explanation of the branches falling under these rules and regulations. The study is divided into an introduction and two sections. The first topic was devoted to the definition of jurisprudential rules. The second topic is devoted to talking about the regulations of jurisprudence related to what is permitted and prohibited from animals. This study attained a number of results, including: The book included a number of jurisprudential rules related to what is permitted and forbidden to be eaten from animals, including: Everything that the text states permissible to be eaten is permitted. Everything that is prohibited from being eaten is prohibited. As a common rule, things are halal (permitted to be eaten) until the evidence indicates the prohibition. If the halal and the haram met, the haram prevailed according to the principle of goodness and malignancy. And a number of regulations, including: Every fanged wild animal, so it is forbidden to be eaten. Every bird with a claw, is forbidden to be eaten too. All animals that are to be killed, are forbidden to be eaten. What is forbidden to be killed, is also forbidden to be eaten. All insects are prohibited from being eaten, except for what is being excluded. Everything that feeds from impurities, is forbidden to be eaten. |
