| 520 | |a تحاول هذه الدراسة معالجة ظاهرة القرصنة البحرية المعتبرة في جميع التشريعات الدولية والوطنية فعلا إجراميا ومقاربتها بفعل الدفاع الشرعي التي يتخذ أحيانا كثيرة بعض المتشابهات بنشاط القرصنة البحرية فيتداخل الفعلان مما يجعل من الصعوبة بمكان التمييز بينهما في الحالة التي يدعي فيها أصحاب فعل القرصنة البحرية أنهم لا يقومون بذلك سوى دفاعا عن مصالحهم الوطنية. فهذا الدراسة تحاول تلمس المنطقة التي يفترق فيها فعل القرصنة البحرية بفعل الدفاع الشرعي الذي يتخذ البحر مجالا لتنفيذ فعله الدفاعي الشرعي. |b This study tries to treat the phenomenon of maritime piracy considered in all international and national legislations as a criminal act while approaching it the act of self-defense which takes a similar simulance in several cases to the activities of maritime piracy. This makes it difficult to distinguish one act to the other in the case where those who commit the act of maritime piracy claim that they are merely defending their national interests. This study tries to touch the part or the act of maritime piracy which is distinguished from the act of self-defense which takes the sea as a sphere of activity to carry out their act. |d Cette étude tente de s’approcher au phénomène de la piraterie maritime incriminée dans toutes les ligislations internationales et nationales comme un acte criminel et sa comparaison avec l’acte de légitime défense qui prenne souvent des similitudes avec les activités de la piraterie maritime, ce qui rend difficile des les distinger dans le cas où les pirates tente de justifier leurs actes comme une défense de leurs intérets nationaux. Cette étude tente de toucher une zone où se distingue l’acte de la piraterie maritime de l’acte de légitime défense qui prend la mer pour une sphère pour exécuter leur acte de légitime défense. | ||
