| المستخلص: | جاء هذا البحث ليتناول موضوعا أصوليا وهو المصلحة المرسلة وعلاقة هذه المصلحة المرسلة في السياسة الشرعية، وتوضيح أثر المصلحة المرسلة في السياسة الشرعية، وبيان أبرز التطبيقات والشواهد المختلفة على تطبيق المصلحة المرسلة على السياسة الشرعية، وقسم هذا البحث على ثلاثة مباحث هي: حقيقة المصلحة المرسلة والسياسة الشرعية وأسباب الأخذ بالمصلحة المرسلة، ثم حقيقة تغير الأحكام وأهميته وأسبابه، وأخيرا أثر المصلحة المرسلة في تغير أحكام السياسة الشرعية. وكانت منهجية البحث على النحو التالي: المنهج الوصفي طريقة التقرير العلمي، والمنهج الحواري للمقارنة بين النقاط المختلفة، وتوصل البحث إلى مجموعة من النتائج التوصيات أبرزها المصلحة المرسلة معتبرة لدى الفقهاء جميعا، وإن اختلف توصيفها، وأن المصلحة المرسلة تعد مؤثرة في السياسة الشرعية، ويوصي الباحث بضرورة بيان دور المصلحة المرسلة في المعاملات وغيرها من أبواب الفقه المختلفة لتبين للناس الأحكام المختلفة للمسائل المستجدة. وهذا المصدر فيه من المتسع لمواكبة تطورات الناس بما يحقق مصالحهم وحاجاتهم وفيه المجال الواسع لتأصيل الفقه السياسي أو السياسة الشرعية؛ لأن السياسة الشرعية هي فقه المصالح التي تقتضيها ظروف الأمة في كل زمان ومكان، وبما أن السياسة الشرعية قائمة على فقه المصالح، فإن هذه المصالح قد تتغير وتتبدل من زمن إلى آخر ومن مكان إلى آخر. This research addresses the position of the fundamentalist, which is the sent interest and the relationship of this interest sent in the legitimate policy, and to clarify the impact of the sent interest on the legitimate policy, and to show the most prominent applications and various evidence on the application of the interest sent to the legitimate policy. This research is divided into three sections. First, we have the reality of the interest and the policy Legitimacy and the reasons for adopting the sent interest. Second, we have the reality of changing the rulings, its importance and its causes. And finally, we have the effect of the sent interest in changing the rulings of the legitimate policy. The descriptive approach was used. The scientific report and dialogue were also used to compare the different major points. The research reached a set of recommendations. The research indicates that the general political interest is considered influential in legitimate policy. Therefore, the researcher recommends the necessity of the role of the interest in transactions to show people the different provisions of emerging issues. This source has ample space to keep pace with people’s developments in a way that achieves their interests and needs, and it has a wide scope for rooting political jurisprudence or legitimate politics. Since legitimate politics is based on the jurisprudence of interests, these interests may change from time to time and from place to another. |
